RECOMMENDED ACTION:
That the City Council INTRODUCE Ordinance No. Ids -6Og tiPPROVING Municipal Code
Amendment 01-04.
ITEM EXPLANATION:
Section 10.40.015(b)(1)(2) of the Municipal Code prohibits the parking of any vehicle on a street or
public right-of-way for the primary purpose of advertising that vehicle for sale. The proposed Sign
Code if approved will place all city sign regulations into chapter 21.41 of the Municipal Code, thus
making the sign regulations in chapter 10.40 unnecessary. Moreover, the proposed Sign Code
contains regulations that allow vehicles, if legally parked, on City streets and public right-of-ways to
advertise that vehicle for sale. This provision of the proposed Sign Code is consistent with recent
court decisions on the matter. It also addresses the City’s interest in preserving the aesthetic values
of the community by regulating the number (2 per vehicle) and the size (10” by 12”) of the allowed
signs.
The proposed MCA also corrects a typographically error in subsection (a).
ENVIRONMENTAL:
The Planning Director has determined that the project is exempt from the California Environmental
Quality Act (CEQA) under the general rule provision of the Act (515061 (b)(3) of the CEQA
Guidelines). This provision states that CEQA applies only to projects having the potential to cause a
significant effect on the environment. The proposed Municipal Code amendment merely deletes
regulations for signs advertising vehicles for sale from chapter 10.40 (CMC) and new regulations
governing signs advertising vehicles for sale are provided in the proposed Sign Code (chapter 21.41
CMC).

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, REPEALING A PORTION OF TITLE
10, CHAPTER 10.40, SECTION 10.40.015 OF THE CARLSBAD
MUNICIPAL CODE.

The City Council of the City of Carlsbad, California, does ordain as follows:
SECTION I: That a portion of Title 10, Chapter 10.40 of the Carlsbad Municipal Code is
repealed. The amended Section 10.40.015 reads as follows:
Title 10 VEHICLES AND TRAFFIC
Chapter 10.40 STOPPING, STANDING AND PARKING
10.40.015 Prohibited purposes for parking on roadway.
(a) No person shall stand or park any commercial vehicle on any street for the purpose of
loading or unloading any merchandise or goods except in authorized loading zones as provided
in Section 10.40.085
(b) No person shall stand or park any vehicle on any street for the purpose of washing, greasing
or repairing the vehicle, except for repairs necessitated by an emergency.
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be
published at least once in a publication of general circulation in the City of Carlsbad within
fifteen (15) days after its adoption.
