HD. &#‘~ THE PROFESSIONAL ENGINEERING SERVICES AGREEMENT MTG. 1 l/06/01 WITH DOKKEN ENGINEERING FOR RANCH0 SANTA FE ROAD CITY ATTY. REALIGNMENT AND WIDENING. PROJECT NO. 3190 I RECOMMENDED ACTION: Adopt Resolution No. dm I - 3 3 0 approving Amendment No. 6 to the Professional Engineering Services Agreement with Dokken Engineering for Ranch0 Santa Fe Road Realignment and Widening, Phase 1, Project No. 3190. I ITEM EXPLANATION: In 1987, the City Council made the decision to realign Ranch0 Santa Fe Road from La Costa Avenue to Melrose Drive. Through a consultant selection process, Dokken Engineering was retained as the best qualified bridge design and engineering firm to provide the services needed for the project. The final design plans, specifications and estimates for Phase 1 are nearing completion. During the course of the design process, the City Engineering Department and Dokken Engineering have been coordinating efforts with other utility agencies to include master plan facilities into the roadway as part of the construction process. Coordination has also been ongoing with the adjacent property owners to facilitate placing wet and dry utility lines into the roadway to facilitate future development with minimal disturbance to traffic utilizing the new road alignment. The additions to the design to be implemented with this amendment are the result of the continuing coordinated efforts described above. In addition, this amendment provides for the design of grading plans for off-site wetlands mitigation area and setting slope stakes for the clearing of the Phase 1 area. Portions of the work included in this amendment involve facilities that either belong to other agencies or are the responsibility of the adjacent landowner. The respective agencies and the adjacent landowner will reimburse the City of Carlsbad for the cost of designing these facilities. Staff recommends that the City Council approve Amendment No. 6 to the agreement with Dokken Engineering, to provide additional engineering services for the final plans, specifications and cost estimate for Phase 1. I FISCAL IMPACT: The estimated costs for the additional engineering services is $135,300 with a contingency of $20,200 for a total of $155,500. However, portions of this estimated cost are subject to reimbursement by other public agencies and the adjacent landowner as listed below: Carlsbad Municipal Water District $1,460 Villages of La Costa $6,953 Total Estimate Reimbursablea’$: ” ’ $8.413 I Therefore, the net cost to the City of Carlsbad is estimated to be $147,087. There are sufficient funds available from existing appropriations for this amendment to the agreement. The City Council passed Resolution No. 2000-128 approving Addendum No. 2 to the Final EIR for Ranch0 Santa Fe Road Realignment on April 25, 2000. This EIR covers the realignment and widening of Ranch0 Santa Fe Road from La Costa Avenue to Melrose Drive. EXHIBITS: 1. WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary and in the public interest to approve Amendment No. 6 to the professional engineering services agreement with Dokken Engineering, in the amount of $135,300, for additions to the final plans, specifications and estimate for Phase 1, preparation of grading plans and specifications for the off-site wetlands mitigation area and slope staking of the Phase 1 area for Phase 1 and for a design contingency of $20,200 for a total cost of $155,500; and WHEREAS, the contractor, Dokken Engineering possesses the necessary skills and qualification to provide the needed services; and WHEREAS, additions and changes to the plans, specifications and estimate to incorporate utilities in the roadway for future development, and survey activities for setting slope stakes in preparation of clearing activities is required to complete Phase 1 of the Ranch0 Santa Fe Road Project; and WHEREAS, Subsection 3.28.172(c)(l) of the Carlsbad Municipal Code authorizes the City Manager to approve change orders in an amount equal to the contingency set at the time of contract award; and WHEREAS, an amendment to the consultant agreement with Dokken Engineering has been prepared and submitted hereto. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That Amendment No. 6 to the agreement between the City of Carlsbad and Dokken Engineering is hereby approved in the amount of $135,300 and the Mayor is authorized and directed to execute said amendment. 3. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 6th day of NOVEMBER , 2001 by the following vote, to wit: AYES: Council Members Lewis, Kulchin, Finnila, Nygaard, Hall NOES: None ,./ .I ATTEST: w=-) Page 2 of Resolution No. 2001-330 AMENDMENT NO. 6 TO AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES ON RANCH0 SANTA FE ROAD, PROJECT NO. 3190 (DOKKEN ENGINEERING) This Amendment No. 6 is entered into and effective as of the 6 7-4 day of 2001, amending the agreement dated February 10, 1988 (the “Agreement”) n the City of Carlsbad, a municipal corporation, (“City’), and Dokken Engineering, Inc., (“Contractor”) (collectively, the “Parties”) for Ranch0 Santa Fe Road, Phase I. RECITALS A. On September 22, 1998, the Parties executed Amendment No. 1 to the Agreement to prepare construction plans, specifications, cost estimate and related documents for Ranch0 Santa Fe Road, Phase I; and B. On June 1, 1999, the Parties executed Amendment No. 2 to the Agreement to extend the limits for Phase 1 approximately 2,000 feet north and relocate the interim detour connection; and C. On April 25, 2000, the Parties executed Amendment No. 3 to the Agreement to prepare construction plans, specifications, cost estimate and related documents for Ranch0 Santa Fe Road, Phase 2; and D. On April 25, 2000, the Parties executed Amendment No. 4 to the Agreement to add additional elements to the final plans, specifications and estimates for Ranch0 Santa Fe Road Phases 1 & 2; and E. On July 20, 2001, the Parties executed Amendment No. 5 to the Agreement to prepare plans, specifications and cost estimate for clearing of Ranch0 Santa Fe Road, Phase I; and F. The Parties desire to alter the Agreement’s scope of work to add additional elements to the final plans for Phase I, revise the recycled water line size, prepare grading plans for off-site wetlands mitigation area and slope stakes for Phase I clearing; and G The Parties have negotiated and agreed to a supplemental scope of work and fee schedule, which is attached to and incorporated by this reference as Exhibit “A”, Scope of Services and Fee. NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Contractor agree as kllows: 1. In addition to those services contained in the Agreement, as may have been amended from time to time, Contractor till provide those services described’in Exhibit “A”. 2. City will pay Contractor for all work associated with those services described in Exhibit “A” on a time and materials or lump sum basis per each task listed with the total of all tasks, not-to-exceed one hundred, thirty-five thousand, three hundred dollars ($135,300.00). Contractor will provide City, on a monthly basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and related activities and costs for approval by City City Attorney Approved Version #04.11 .Ol 1 3. Contractor will complete all work described in Exhibit “A” by February 10, 2002. 4. Ali other provisions of the Agreement, as may have been amended from time to time, will remain in full force and effect. 5. All requisite insurance policies to be maintained by Contractor pursuant to the Agreement, as may have been amended from time to time, will include coverage for this Amendment. 6. The individuals executing this Amendment and the instruments referenced in it on behalf of Contractor each represent and warrant that they have the legal power, right and actual authority to bind Contractor to the terms and conditions ofthis Amendment.
