CA BUILDING, PALOMAR FORUM, CARLSBAD RACEWAY INDUSTRIAL PARK DEPT. HD. RECOMMENDED ACTION: That the City Council adopt Resolution No. %0 I- 36 7 approving the General Plan Amendment, GPA 01-05, amending the General Plan for properties commonly known as Pacifica Palomar Office Building, Palomar Forum, and Carlsbad Raceway Industrial Park. ITEM EXPLANATION: State law allows a mandatory element of the General Plan to be amended no more than four times per year. Each amendment, however, may include more than one change to the General Plan. In this case, there are three changes to the General Plan to amend the land use and open space and conservation elements to provide for proposed development on the sites commonly known as the Pacifica Palomar Office Building, the Palomar Forum, and the Carlsbad Raceway Industrial Park. This action will result in consistency between the General Plan and the zoning and development permits required for these projects. The duly noticed public hearing for the Pacifica Palomar Office Building (GPA Ol-OUCDP Ol- 02) was held on November 6, 2001; the duly noticed public hearings for Palomar Forum (GPA Ol-07/ZC 01-06) and Carlsbad Raceway Industrial Park (GPA 98-051ZC Ol-07/LFMP 87-l 8(B)) were held on December 4,200l. During its discussions of the Pacifica Palomar Office Building, the developer offered and the Council accepted 24” box Cyprus trees with a minimum 12’ height subject to approval of the Planning Director. During discussions of Palomar Forum and Carlsbad Raceway Industrial Park, Council amended conditions regarding the construction of the Faraday Avenue extension to include the appropriate agency permissions. FISCAL IMPACT: The Planning Director determined that the Pacific Palomar Office Building project would not have a significant impact on the environment and issued a Mitigated Negative Declaration for it on July 5, 2001. The Planning Director issued a Mitigated Negative Declaration for the Palomar Forum project on July 15, 2001. The Planning Director issued a Mitigated Negative Declaration for the Carlsbad Raceway Industrial Park on July 15, 2001. EXHIBITS: 1. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Land Use and Open Space and Conservation Elements of the General Plan for the project commonly known as Pacifica Palomar are amended as shown on Exhibit GPA 01-05 dated September 19, 2001 and attached hereto as Exhibit “A”, and as provided in City Council Resolution No. 2001-334 (on file in the office of the City Clerk). b. That the Land Use and Open Space and Conservation Elements of the General Plan for the project commonly known as the Palomar Forum are amended as shown on Exhibit GPA 01-07 dated December 4, 2001, attached hereto as Exhibit “B”, and as provided in City Council Resolution No. 2001-352 (on file in the office of the City Clerk). c. . That the Land Use and Open Space and Conservation Elements of the General Plan for the project commonly known as the Carlsbad Raceway Business Park are amended as shown on Exhibit GPA 98-05 dated December 4, 2001, attached hereto as Exhibit “C”, and as provided in City Council Resolution No. 2001-351 (on file in the office of the City Clerk). 3. EFFECTIVE DATE: This resolution shall be effective upon its adoption, except as to the General Plan Amendment, which shall be effective thirty (30) days following its adoption.
