Adopt Resolution No. sm 1 - 3 60 accepting bids and awarding the contract for Ranch0
Santa Fe Road Realignment and Widening, Phase 1 Clearing, Project No. 3190.

ITEM EXPLANATION:
The Ranch0 Santa Fe Road Realignment and Widening, Phase 1 Clearing consists of staking the
limits of work, placing environmental fencing at the limits of work, clearing vegetation and providing erosion control measures. The work extends from La Costa Avenue northerly along the new road
alignment to the end of Phase 1, a length of approximately 1.7 miles. The plans and specifications
for the project have been completed. ClearinN the limits of work ahead of construction will allow the
habitat to be removed prior to February 15 , the beginning of the Gnatcatcher nesting season.
Construction of the realignment is estimated to begin in Summer 2002. If the habitat is not cleared
prior to February 15’h, the construction start will be delayed until after the end of the Gnatcatcher
nesting season in August 2002.
On October 16, 2001, City Council authorized the advertisement for bids for the clearing operation. Purchasing Department received seven (7) sealed bids on November 20,200l as shown in Table 1.

The Engineer’s Estimate for the clearing operations was $850,000. The apparent low bidder is Erreca’s. All bid documents submitted by Erreca’s have been reviewed by staff and found to be in
order.
FISCAL IMPACT:
Staff has been working with the property owners in Local Facilities Management Zones 11, 12,
and a small portion of 6, to form a Community Facilities District (CFD) since the early 90’s to finance
the construction of Ranch0 Santa Fe Road and certain portions of Olivenhain Road improvements.
Delays in the formation process of the proposed CFD (known as CFD No. 2) proved to be a major
problem for some of the property owners who were ready to begin development of their projects, so Council began allowing property owners to prepay their obligation by entering into agreements
with these property owners.
Since 1993, Council has been entering into these prepayment agreements and, to-date, the City has
received over $20 million in prepayment fees. Appropriations currently available for this contract
exceed $17 million, thus there is sufficient funding.

The estimated costs for the Ranch0 Santa Fe Road Realignment and Widening Project is $37.2
million. The total estimated clearing cost is shown in Table 2.

Should the clearing project be stopped by unforeseen circumstances beyond the control of the City, the potential cost to the City could range from $50,000 upwards to $150,000 or more depending on
how much work the contractor has started when the project is halted.

CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
THE CONSTRUCTION CONTRACT FOR RANCH0 SANTA FE
ROAD REALIGNMENT AND WIDENING, PHASE 1 CLEARING,
PROJECT NO. 3190.
WHEREAS, plans and specifications have been approved by the City Council of the City
of Carlsbad, California, for Ranch0 Santa Fe Road Realignment and Widening, Phase 1 Clearing,
Project No. 3190; and
WHEREAS, the low bid received for the clearing work was submitted by Erreca’s in the
amount of $513,904.25; and
WHEREAS, the low bid received for the clearing work submitted by Erreca’s is responsive;
and
WHEREAS, the total estimated costs for the Ranch0 Santa Fe Road Realignment and
Widening, Phase 1 Clearing Project is $642,379.25; and
WHEREAS, there are sufficient funds available in the project account for completibn of
this project; and
WHEREAS, based on the approved Environmental Impact Report and addendums thereto
and the approved Habitat Conservation Plan for the road realignment and widening, there will be
no additional significant effect, not analyzed therein, and that no new or additional mitigation
measures are required; therefore no new environmental document is required.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the bid of $513,904.25 by Erreca’s for the Ranch0 Santa Fe Road
Realignment and Widening, Phase 1 Clearing Project is accepted.
3. That the City Manager is hereby authorized to approve construction change orders
up to $77,085.

4. That the award of this contract is contingent upon Erreca’s executing the required
~ contract and submitting the required bonds and insurance policies, as described in the contract,
‘within twenty (20) days of adoption of this resolution. The City Manager may grant reasonable
extensions of time.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 11th day of DECEMBER , 2001 by the following vote, to wit:
