C=N”ATION OF ABANDONED VEHICLE ABATEMENT PROGRAM THROUGH EXTENSION OF VEHICLE REGISTRATION FEE CITY MGR RECOMMENDED ACTION: 1. Adopt resolution approving an extension of registration fees, as authorized by the State of California, imposed on vehicles registered in the County of San Diego, for 10 years from date of the approval of this Resolution, in accord with California Vehicle Code sections 9250.7 and 22710. (Adopt Resolution No. 2001-361.) ITEM EXPLANATION: Sections 9250.7 and 22710 of the California Vehicle Code authorized the establishment of the San Diego County Abandoned Vehicle Abatement Service Authority (“AVASA”) in 1991 and the imposition of a $1 fee on vehicles registered in the County of San Diego. Since Fiscal Year 1994, revenue from registration fees collected to supportSan Diego County’s Abandoned Vehicle Authority (AVA) has returned almost $17 million to local jurisdictions. These registration fees are used exclusively for the abatement, removal, and disposal of any abandoned, wrecked, dismantled, or inoperative vehicles or vehicle parts as public nuisances, on private or public property, to combat neighborhood blight and decay. On August 13, 2001, Governor Davis signed SB 106 into law, thereby providing the mechanism needed to alleviate concerns related to an upcoming sunset clause regarding the 4VA program. The amended regulation will allow the authority to continue AVA efforts via regional discretion through an affirmative vote of two-thirds of the Board of Supervisors and the acceptance of the majority of local participating jurisdictions that represent the majority of the population, in increments of up to 10 years. Without an extension of the registration fees, authority for the registration fees will expire in April 2002. The City of Carlsbad, along with the County of San Diego and the majority of cities in the County, is a member of the AVASA. In FY 2001, the City of Carlsbad received $123,351 in registration fees from the AVASA, which paid for 100 percent of the City’s costs of abating nuisance vehicles, with the balance going into a reserve fund for future Carlsbad AVA sxpenditures. FISCAL IMPACT: The continuation of the AVA program means the continued collection of vehicle registration fees dedicated to the program. Fees collected on behalf of the City of Carlsbad totaled §123,351 in FY 2001. These monies are used solely to reimburse the costs associated with nvestigating and removing abandoned vehicles in Carlsbad. EXHIBITS: 1. Resolution No. d00/ -361 1 2 3 4 5 6 7 8 9 IO 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2001-361 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, TO EXTEND THE COLLECTION OF VEHICLE REGISTRATION FEES FOR THE PURPOSES OF ABANDONED VEHICLE ABATEMENT WHEREAS, sections 9250.7 and 22710 of the California Vehicle Code authorized the establishment of the San Diego County Abandoned Vehicle Abatement Service Authority (“AVASA”) in 1991 and the imposition of a $1 fee on vehicles registered in the County of San Diego; WHEREAS, these sections impose an additional $2 fee on commercial vehicles registered in the County of San Diego, effective December 31, 2001; WHEREAS, these registration fees are used exclusively for the abatement, removal, and disposal of any abandoned, wrecked, dismantled, or inoperative vehicles or vehicle parts as public nuisances, on private or public property, to combat neighborhood blight and decay; WHEREAS, the City of Carlsbad, along with the County of San Diego and the majority of cities in the County, is a member of the AVASA; II WHEREAS, in FY 2001, the City of Carlsbad received $123,351 in registration fees from the AVASA, which paid for 100 percent of the City’s costs of abating nuisance vehicles with the balance going into a reserve fund for future Carlsbad AVA expenditures; WHEREAS, Senate Bill 106, chaptered on August 13, 2001, amended California Vehicle Code sections 9250.7 and 22710 to allow for an extension of the registration fees in increments of up to IO years; WHEREAS, in order for the registration fees to be extended, Senate Bill 106 requires a county’s board of supervisors, by a two-thirds vote, and the cities with the majority of the incorporated population within the county to adopt resolutions approving an extension of the registration fees; NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad, that the registration fees, as authorized by the State of California, imposed on vehicles registered in > 1 2 3 4 5 6 7 8 9 IO 11 12 13 14 16 17 18 19 20 21 22 23 24 25 26 27 28 the County of San Diego, are extended for 10 years from date of the approval of this Resolution, in accord with California Vehicle Code sections 9250.7 and 22710.
