RECOMMENDED ACTION:
Adopt Resolution No. JC0\ - 35% approving the final map for Carlsbad Tract CT 97-l 6(A), Kelly
Ranch Core, and authorizing the City Clerk to process the map for recording.
ITEM EXPLANATION:
Engineering staff has completed checking the final map of Carlsbad Tract CT 97-16(A), also known
as Kelly Ranch Core. This is a 174.037-acre property subdivided for residential development. This
subdivision is within Local Facilities Management Plan (LFMP) Zone #8 and is generally located on
Cannon Road between El Camino Real and Faraday Avenue. It is comprised of 171 lots with uses
as follows: 147 single-family residential lots, three multi-family residential lots, seven non-residential
lots, lot 80 (existing residence), and 13 open space lots. There is also a remainder parcel.
The final map conforms substantially with the tentative map as approved by Planning Commission
on May 2, 2001 per Resolution No. 4963, and with the modified conditions pursuant to City Council
Resolution No. 2001-165. The final map also conforms to the General Plan, all the applicable
requirements of the Municipal Code, City Standards, and Growth Management Plan. The applicant,
Kelly Land Company, is requesting the recordation of said final map.
FISCAL IMPACT:
The developer pays a plancheck fee to cover the expense of planchecking and processing the final
map for recording. There is no fiscal impact to the City. All appropriate fees will be paid if and when
building permits are issued for this project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE FINAL MAP FOR
CARLSBAD TRACT 97-16(A), KELLY RANCH ,CORE, AND
AUTHORIZING THE CITY CLERK TO PROCESS THE MAP FOR
RECORDING.
WHEREAS, Kelly Land Company, a Delaware Corporation, has submitted a final map
tnown as Carlsbad Tract 97-16(A) to the City of Carlsbad for approval; and
WHEREAS, the tentative map of Carlsbad Tract 97-16(A) with conditions, was approved
3y the Planning Commission on May 2, 2001, pursuant to Resolution No. 4963; and
WHEREAS, the City Council did on June 12, 2001 adopt Resolution No. 2001-165
approving the tentative map; and
WHEREAS, the Public Works Director has determined that said map substantially
conforms to said conditionally approved tentative map; and
WHEREAS, the conditions of approval for said final map have been completed or
secured; and
WHEREAS, the developer has offered public street and public easements for dedication
:o the City of Carlsbad; and
WHEREAS, the final map conforms to the City of Carlsbad General Plan and all
.equirements of City Codes and Standards; and
WHEREAS, the City Council of the City of Carlsbad determined it to be in the public
nterest to approve said final map; and I
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
zalifornia, as follows:
1. That the above recitations are true and correct.
2. That said final map known as Carlsbad Tract 97-16(A), Kelly Ranch Core, which is
)n file with the Public Works Director and is incorporated herein by reference, is accepted.
3. That the City accepts the dedications shown on the final map.
4. That the City Clerk is authorized to sign the Certificate of Acceptance on the final
nap.
5. That the City Clerk is authorized to cause the original final map to be recorded in
he Office of the County Recorder of San Diego County, State of California.
1 6. That the City Clerk is authorized to release the map to First American Title
2 Company for recording in the Office of the County Recorder.

4 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 18th day of DECEMBER , 2001 by the following vote, to wit: 5

Please have the Kelly Ranch Fianl Map agenda item continued to December 18.
Kelly Ranch Company was not able to get the final document signed by Coastal’s legal office. Apparently
the attorney who was working on it has become seriously ill. Another attorney has been assigned and is
actively working on it.

Dear Mr. Bowers:
Thank you for discussing the Final Map for this project with me on Tuesday, December
18, 2001. Based on the update and progress that you and Attorney Neils have made on
the documents and hearing that they are substantially complete, I advised the City
Council to approve the Final Map, subject to the actual execution of the documents for
approval by the City Engineer prior to sending the Final Map to the San Diego County Recorder for recordation. I understand that will be happening imminently.
I certainly appreciate the effort and priority you have given this matter so the Council
would be in a position to approve the Final Map. The Cannon Road associated with this
project is an important and urgently needed link to the City’s overall transportation plan.
