ENG TITLE: APPROPRIATE FUNDS FOR BUENA VISTA CREEK CHANNEL MAINTENANCE DISTRICT BENEFIT AREA NO. 1 RECOMMENDED ACTION: CITY MGRS Adopt Resolution No. ACY)/ -~?6 8’ authorizing the appropriation of funds for the Buena Vista Creek Channel Maintenance District Benefit Area No. 1. ITEM EXPLANATION: The Buena Vista Creek Channel is located south of Highway 78 and extends from El Camino Real west to the Jefferson Street Bridge and discharges into the Buena Vista Lagoon. The City has the responsibility to maintain Buena Vista Creek Channel through the Buena Vista Creek Channel Maintenance District (District) which was formed on August 8, 1989 according to the provisions of the Benefit Assessment Act of 1982. The formation was requested by Plaza Camino Real, Hughes North County Associates and Hughes North County Associates II in order to provide an effective, consistent means of clearing the channel to allow for design flow. The maintenance program is administered by City staff and consists of the removal of silt, vegetation and other debris within the constraints of permits from the Coastal Commission, the Army Corps of Engineers and the California Department of Fish and Game. Maintenance work is performed on an “as-needed” basis, with major vegetation removal occurring approximately every three to four years. The first major contract clearing was completed in May 1993. The second was completed in April 1997. The next maintenance project is complex and will require several flora and fauna surveys. These surveys will be used to obtain the resource agency permits noted above. Staff proposes that the project permits include routine maintenance of the channel rather than the current program of clearing the channel every few years. Assessments are evaluated annually. Funds have been deposited in the districts fund balance to adequately cover the cost of major maintenance efforts. On July 24, 2001, City Council adopted the annual benefit assessments for the channel. Additionally, City Council was made aware that the maintenance program permitting process would begin later in the year. Appropriation of funds is necessary to begin the environmental review and permit process which will be used for the maintenance project. FISCAL IMPACT: The estimated cost for the maintenance project is shown in Table 1 and totals $750,000. The estimate for construction is based on previous bids received during the limited clearing performed in 1997. The Buena Vista Creek Channel Maintenance District Benefit Area Fund currently has a balance of $816,000. Therefore, sufficient funds are available in the Buena Vista Creek Channel Maintenance District Fund for the maintenance project. Page 2 of Agenda Bill No. 1 b ! q 7 6 ENVIRONMENTAL REVIEW: The first phase of the project requires environmental studies required for permit applications. Staff will return to the City Council for certification of CEQA documents prior to commencing with more than 30 percent design level of the maintenance project. EXHIBITS: 1. Location Map. 2. 3. WHEREAS the City Council of the City of Carlsbad, California, did form the Buena Vista Creek Channel Maintenance District on August 8, 1989 pursuant to the petition of the property owners and pursuant to the terms and provisions of the Benefit Assessment Act of 1982, being Chapter 6.4, Division 2, Title 5 of the Government Code of the State of California, commencing with Section 54703, said area of benefit being known and designated as Benefit Area No. 1 (hereinafter referred to as the “Benefit Area”); and WHEREAS, the City Council has determined it necessary, desirable, and in the public interest to perform channel maintenance; and WHEREAS, permits are required from the relevant resource agencies to perform the . maintenance; and WHEREAS, assessments have been levied over the last few years and sufficient funds are available to prepare the studies required for the permits, to perform the design of the maintenance plans and to perform the maintenance work. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Finance Director is hereby authorized to appropriate $750,000 from the Buena Vista Creek Channel Maintenance District, Fund to the appropriate outside services account.
