ENG RECOMMENDED ACTION: Adopt Resolution No. &w36q authorizing compensation to San Diego Gas and Electric (SDG&E) for public road crossings within the Cannon Road West right-of-way, Project No. 3184. ITEM EXPLANATION: Cannon Road West Reach 2 Segment 2 (Segment 2) which will extend Cannon Road to El Camino Real, is proposed to start construction in December 2001. The project has two road crossing locations within the SDG&E 150-foot electric transmission easement. Kelly Land Company (KLC) has been conditioned to construct Segment 2. Segment 2 is funded through Bridge and Thoroughfare District No. 3 (BTD). The BTD fund includes all costs associated with the use of the right of way. Compensation for the road crossings is required because SDG&E has senior rights for the transmission easement. There are two road crossings through existing SDG&E easements. Compensation is based on the square footage of the entire use area. The Joint Use Agreement that will document the sharing of these rights between SDG&E and the City will be recorded on the Kelly Ranch final map. Kelly Land Company has previously dedicated Cannon Road to the City of Carlsbad by easement. Staff recommends authorizing payment of compensation for the road crossings to SDG&E in the amount of $49,556. ENVIRONMENTAL IMPACT: The Planning Director has determined that the requested action is consistent with prior CEQA review. The project was reviewed in the Kelly Ranch Environmental Impact Report and the Mitigated Negative Declaration for Cannon Road West Reach 2. Significant environmental impacts identified by those CEQA documents were determined to be mitigable to levels of less than significant. Permits from the resource agencies have been received. FISCAL IMPACT: The compensation total for the road crossings within the transmission easements is $49,556. The BTD anticipated the costs and sufficient funds are available in the project account. WHEREAS, Cannon Road West Reach 2 Segment 2 (Segment 2) will extend 6 Cannon Road from Faraday Avenue to Frost Drive is scheduled to start construction in 7 December 2001; and 8 WHEREAS, Segment 2 has two road crossing locations within the San Diego Gas and 9 Electric Company (SDG&E) 150-foot electric transmission easement; and 10 WHEREAS, SDG&E has senior rights for the transmission easement; and 11 WHEREAS, the City Council of the City of Carlsbad, California has reviewed the need for 12 compensation to SDG&E for the road crossings; and 13 WHEREAS, compensation is based on the square footage of the road easement for ,4 Cannon Road crossing the SDG&E right-of-way; and 15 16 17 18 19 WHEREAS, SDG&E purchased the easement for fair market value; and WHEREAS, the use of Cannon Road West limits SDG&E’s rights to the land; and WHEREAS, the Joint Use Agreement that documents the sharing of these rights between SDG&E and the City will be recorded on the Kelly Ranch final map CT 97-16(A); and WHEREAS, the project is in full compliance with the California Environmental Quality Act; and 20 WHEREAS, compensation for the road crossings is $0.56 per square foot for 88,492 21 square feet for a total of $49,556; and 22 WHEREAS, the Bridge and Thoroughfare District No. 3, that is funding the project, 23 includes compensation for the road crossings and sufficient funds are available in the project 24 25 26 27 0 28 account; and WHEREAS, it is in the best interest of the City to compensate SDG&E for the road crossings. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. II 1 2. That sufficient funds are available to compensate SDG&E for the road crossings. 2 3. These fees were based on square footage calculations provided by Project Design Consultants. The fees are as follows: $20,718.00 Parcel A (Cannon Road S/O Hemingway Dr.) $28,838.00 Parcel B (Cannon Road N/O Hemingway Dr.) $49,556.00 Total Road Crossing Fee SDG&E rate-payers purchase these electric transmission easements for fair market value. When asked to surrender a portion of these rights to municipalities (i.e. road crossings), SDG&E rate-payers must be reimbursed for those lost rights.
