I RECOMMENDED ACTION:
Adopt Resolution No. -7 to approve setting the date, time, and place for a public hearing to establish Connection Fee for El Camino Real Sewer.
I ITEM EXPLANATION:
In the past twelve months, meetings were held at the request of property owners to consider developing a public sewer pipeline along El Camino Real between Tamarack Avenue and Chestnut Avenue. Staff developed a sewer benefit area map to determine which properties would benefit from the sewer pipeline. This map is shown in Exhibit 1. Staff also developed the alignment and construction cost for the public sewer pipeline, which includes 4,280 feet of 8-inch diameter PVC pipe, plus manholes and laterals having an estimated cost of $418,000 as shown in Table 1.
Staff requested that the property owners submit an informal written petition to the City, with the purpose of determining the amount of interest by the property owners in the sewer project. The petition was submitted, and it indicated that a majority of the land ownership wanted to proceed with the project.
Staff investigated several methods to distribute the cost of the project to each benefiting property owner. A recommended approach was to utilize the City’s land use zoning to determine the maximum number of equivalent dwelling units (EDU’s) that could be developed on each parcel of land. Those parcels with an existing residence were kept at one EDU per parcel regardless of the acreage of the property. This approach resulted in a potential for 28 EDU’s on 20 parcels. There are a total of 14 property owners. Seven property owners have an existing residence and seven property owners own undeveloped land.
The cost share was established by prorating the total construction cost using a ratio of the number of EDU’s per parcel divided by the total number of EDU’s in the benefit area. The result is shown on Table 2. With this information, property owners benefiting from the proposed sewer pipeline were invited to attend two meetings to express their opinion on constructing the sewer pipeline.
Based on the discussions with the property owners, the formative costs of an assessment district were determined to be an additional $153,000, which was too high. Therefore, it is proposed that the City front the cost of the sewer project, and then be reimbursed by each property owner through a sewer connection fee program. Similar programs were approved by the City Council in 1984 for the Buena Vista Valley Sewer and in 1991 for the Holly Brae Sewer. Property owners with occupied or developed lots would be required to pay their fee assessment when they connect to the sewer. Owners of undeveloped property would be required to pay the fee upon issuance of a building permit for the property. This condition would be recorded on each property. Under the proposed approach the City may not be reimbursed totally if a parcel of undeveloped land is not developed or if an existing home does not connect to the sewer. In reference to Chapter 13.04.030, “Use of public sewers required”, the City Engineer will not be notifying property owners to connect existing residences to the sewer unless their private on-site septic tank/leachfield fails.
Chapter 13.08 of the Carlsbad Municipal Code establishes provisions that compel a property owner to pay such owner’s proportionate share of the cost of a sewer main to serve such owner’s property as a precondition to connecting to such sewer main. Section 13.08.010 provides that whenever a person applies to connect to a sewer main, such application may not be acted upon or approved until such person has paid to the City such person’s proportionate share of the cost of such sewer main. Section 13.08.035 authorizes the City Council by resolution to approve a plat map for an area benefited by a sewer main which provides for a fee determined by dividing the cost of the sewer -ain by the number of dwelling units served by such sewer main.

In order to establish such sewer main connection fee, the City must comply with the provisions of Government Code Section 66013 and 66016. Government Code Section 66016 requires that prior to adopting the resolution to levy such sewer main connection fee, the City Council must hold at least one open and public meeting, at which oral and written presentations can be made, as part of
a regularly scheduled meeting. Notice of the time and place of such meeting must be mailed at least
14 days prior to the meeting to any interested person who has filed a written request for such notice.
Staff would, however, recommend that the City Council go beyond these minimum procedural
requirements and schedule a public hearing to consider the establishment of this sewer main
connection fee and that notice of such hearing be mailed at least 14 days prior to such hearing to the owners of each parcel benefited by the sewer improvements as well as any other interested person who has filed a written request for such notice.
ENVIRONMENTAL IMPACT:
If the City Council approves the staff recommendation, appropriate environmental documents will be prepared for the public hearing. The sewer pipeline project would require environmental review through the CEQA process bet&e proceeding with construction.
FISCAL IMPACT:
The project would be initially funded by a loan of $418,000 from the Sewer Replacement Fund to the El Camino Real Sewer. This amount would be appropriated to the El Camino Real Sewer upon establishment of the new connection fee benefit area. There are sufficient funds available in the Sewer Replacement Fund for the project.
Revenue to reimburse the Sewer Replacement Fund would be obtained through the El Camino Real Sewer Connection Fee. It is proposed that the El Camino Real Sewer Connection Fee shall be
established with 28 EDU’s at a cost of $14,929 per EDU. If a higher EDU density actually occurred,
then the fee amount would be reduced proportionately

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, SETTING THE DATE, TIME, AND
PLACE FOR A PUBLIC HEARING TO ESTABLISH CONNECTION
FEE FOR EL CAMINO REAL SEWER.
WHEREAS, the City has determined that certain properties along El Camino Real from
Tamarack Avenue to Chestnut Avenue presently do not have access to a public sewer system
for sewer service; and
WHEREAS, the City has determined that an 8-inch diameter sewer pipeline would be
needed to provide sewer service to the benefiting properties which include 20 parcels of land;
II and
WHEREAS, the cost of the project has been estimated at $418,000 to construct 4,280
feet of 8-inch diameter PVC pipe, manholes and laterals; and
WHEREAS, the project would be funded through a loan of $418,000 from the
Sewer Replacement Fund with the understanding that the replacement fund would be
reimbursed by each benefiting property owner through a sewer benefit area fee program; and
WHEREAS, the City Council will hold a public hearing to consider the establishment of a
connection fee for the El Camino Real Sewer, which will be used to fund construction of the
sewer facilities, which cannot be funded by Sewer Connection Fees.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:

Humphrey over the last couple of months regarding this project, and wbilc it is not the
policy of my office to be involved in local govcmment matters, 1 am sure that the City oc’
C&bad will do everything possible to assist Mrs. Humphrey and the other r&dents
involved in this project b find an equitable solution.
I was able to submit to the State Assembly a request for this project to be inciudcd in the
state budget however, un!&tunately it was not included. 1 bclievc that we need to
continue to work on all levels of government to tind ways to improve our local areas of
infrastructure and this project appears lo bc 3 start.

Installation of a public sewer system would update the arca to modem standards of waste elimination. This project will provide property owners &b an affordable means of hooking up to the scwcr system, thus enabhng them to’develop beatatiful new custoni homes and improve’thc appcarance’ofthc entire area.
