APPROVAL OF A REIMBURSEMENT TO LB/L - CONCORDIA
FOR CONSTRUCTION OF A TRAFFIC SIGNAL AT THE
INTERSECTION OF CARLSBAD VILLAGE DRIVE AND DONNA
DRIVE AND APPROVE APPROPRIATION OF FUNDS

Adopt Resolution No.do68Oo 3 approving a reimbursement to LB/L - Concordia Carlsbad, LLC,
a California Limited Liability Company (“Concordia”), for the construction costs incurred for the
installation of a traffic signal at the intersection of Carlsbad Village Drive and Donna Drive and
approving the appropriation of funds.
ITEM EXPLANATION:
On June 18, 1997, the Planning Commission approved of a 28-lot subdivision known as CT 98-03,
Pacific View Estates per Planning Commission Resolution 4100. On August 5, 1997, the City
Council heard an appeal filed with CT 96-03 and approved the project, subject to conditions per City
Council Resolution No. 97-561. City Council revised condition 58 of Planning Commission
Resolution 4100 to read as follows:
“Construct a traffic signal at Donna Drive and Catlsbad Village Drive prior to occupancy of the
first unit constructed in Phase II or Ill. The City shall reimburse the developer for 75% of the
cost of signal installation.”
Concordia, the developer of CT 96-03, prepared design and construction drawings to cover the
installation of the traffic signal at Carlsbad Village Drive and Donna Drive. These drawings are on file
with the City Engineering Department as drawing No. 386-5. During 2000, Concordia constructed
the traffic signal to the satisfaction of the City Engineer. In May of 2001 the signal became
operational and staff considers it complete.
Pursuant to condition 58 of Planning Commission Resolution 4100, as modified by City Council
Resolution 97-561 Concordia seeks the reimbursement for 75% of the costs associated with the
installation of this signal.
In June of 2001, Concordia prepared audit materials necessary to document the total costs incurred
with the installation of this signal. Engineering staff performed a review of materials and based on
staffs review, the total cost of the signal is evaluated at $138,598. Based on the City’s obligation to
reimburse the developer 75% of the costs of this signal, the developer is owed $103,947.
ENVIRONMENTAL REVIEW
The Planning Director has determined that the requested action is consistent with prior CEQA review.
The project was reviewed for potential environmental impacts under the Environmental Impact
Assessment (EIA) Form Part II for CT 96-03. Planning Commission adopted a Mitigated Negative
Declaration on June 18, 1997 pursuant to Planning Commission Resolution No. 4099.

FISCAL IMPACT:
An appropriation of $125,000 was previously approved in the FY 2000-2001 Capital Improvement
Program (project No. 36191) to cover the costs associated with this signal (Exhibit 2). However, the
appropriation was inadvertently left out of the 2001-02 CIP budget. Since the traffic signal has met
warrants and there are sufficient Gas Tax funds available for the project, staff recommends the
appropriation of $103,947 from the Gas Tax fund to reimburse the developer.

A RESOLUTION OF THE CITY COUNCiL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A REIMBURSEMENT
TO LB/L - CONCORDIA CARLSBAD FOR THE
CONSTRUCTION OF A TRAFFIC SIGNAL AT CARLSBAD
VILLAGE DRIVE AND DONNA DRIVE AND APPROVING THE
APPROPRIATION OF FUNDS.
WHEREAS, on July 18, 1997, the City of Carlsbad Planning Commission approved CT
96-03, Pacific View Estates, for development of a 26-lot subdivision (“Project”), subject to
conditions per Planning Commission Resolution No. 4100; and
WHEREAS, on August 5, 1997, the City Council heard an appeal filed with the Project.
City Council approved the Project, subject to conditions per City Council Resolution No. 97-561;
and
WHEREAS, pursuant to City Council Resolution No. 97-561, the City shall reimburse the
developer of the Project 75% of the costs associated with the construction of the signal at
Carlsbad Village Drive and Donna Drive (‘Signal Improvements”); and
WHEREAS, the developer of the Project, LB/L Concordia Carlsbad, LLC, a California
Limited Liability Company, has properly installed the Signal Improvements to the satisfaction of
the City Engineer. Developer has prepared audit materials necessary to document the costs
associated with the Signal Improvements; and
WHEREAS, City staff has performed a review of the costs associated with the Signal
Improvements. The total cost of the Signal Improvements is evaluated at $138,596; and
WHEREAS, pursuant to City Council Resolution No. 97-561, the City shall reimburse the
developer of the Project, Concordia, $103,947; and
WHEREAS, there are sufficient funds available in the Gas Tax fund for the
reimbursement;

1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

3 1. That the above recitations are true and correct.
4 2. That City Council authorize the Finance Director to appropriate $103,947 of Gas Tax.
