RECOMMENDED ACTION: 0 Hold Public Hearing. 0 Adopt Resolution No. a - 03 7 approving plat map and Reimbursement Connection Fee for El Camino Real Sewer from Tamarack Avenue to Chestnut Avenue. ITEM EXPLANATION: There are twenty (20) parcels of land located along El Camino Real between Tamarack Avenue and Chestnut Avenue that presently do not have access to a public sewer. Existing residences in this area use private on-site septic tanklleachfields for wastewater disposal. To provide a public sewer requires the construction of an 8-inch diameter sewer pipeline that would begin at an existing sewer Avenue as shown in Exhibit 1. The proposed sewer includes manholes and also a service lateral for pipeline at Tamarack Avenue and extend northerly approximately 4,280-feet towards Chestnut each of the 20-parcels. One service lateral will extend partially within a private utility easement to provide service to 5 of the parcels. The estimated construction cost is $420,000. The cost share of the project to each benefiting property owner was established by prorating the total estimated construction cost using a ratio of the total number of equivalent dwelling units (EDU’s) allowed on the parcel in relation to the total number of EDU’s estimated for the benefiting service area. This method was used because all parcels benefit equally in the sewer capacity, not all parcels front the sewer, and the sewer pipeline length is greater than the total front footage of each parcel. The total number of EDU’s per parcel was determined from existing land use zoning approved by the City for each parcel, with the exception that parcels having an existing residence was assumed at 1 EDU rather than the possible number of EDU’s allowed under current zoning. This approach resulted in a potential for 28 EDU’s on 20 parcels of land. There are a total of own parcels that are undeveloped. 14 property owners. Seven property owners have an existing residence and seven property owners To finance the sewer project, staff recommends that the City fund the construction cost through a loan from the Sewer Replacement Fund. The property owners would then reimburse the City’s the parcel of land that they own. Property owners with developed property would be required to pay Sewer Replacement Fund when they pay the sewer reimbursement connection fee attributable to their fee assessment when they connect to the sewer. Owners of undeveloped property would be required to pay the fee upon issuance of a building permit for the property. These conditions would be recorded on each property. Under the proposed funding approach, the City’s Sewer Replacement Fund may not totally be reimbursed if a parcel of undeveloped land is not developed, or if an existing home does not connect to the sewer. In reference to Chapter 13.04.030, “Use of public sewers required”, the City Engineer will not be notifying property owners to connect existing residences to the sewer except when their private on-site septic tanklleachfield fails to handle the wastewater from the existing residence. Page 2 of Agenda Bill No. I 6, 52 9 Chapter 13.08 et seq., of the Carlsbad Municipal Code establishes provisions that compel a property owner to pay such owner’s proportionate share of the cost of a sewer main to serve such owner’s property as a precondition to connecting to such sewer main. Section 13.08.010 provides that whenever a person applies to connect to a sewer main, such application may not be acted upon or approved until such person has paid to the City such person’s proportionate share of the cost of such sewer main. Section 13.08.035 authorizes the City Council by resolution to approve a plat map for an area benefited by a sewer main which provides for a fee determined by dividing the cost of the sewer main by the number of dwelling units served by such sewer main. Government Code Section 66013 and 66016. CALIFORNIA APPROVING A PLAT MAP TO ESTABLISH A SEWER REIMBURSEMENT CONNECTION FEE FOR THE EL CAMINO REAL SEWER FROM TAMARCK AVENUE TO CHESTNUT AVENUE PURSUANT TO THE PROVISIONS OF SECTION 13.08.035 OF THE CARLSBAD MUNICIPAL CODE. WHEREAS, the City Council of the City of Carlsbad has adopted alternative provisions for stablishing a sewer main line cost fee in Title 13, Chapter 13.08, Section 13.08.035 of the :arkbad Municipal Code; and WHEREAS, the method to distribute the sewer main line cost is established by dividing the ost of the sewer project by the number of dwelling units served resulting in a cost per dwelling init. This method was used because the sewer pipeline is greater in length than the parcels .anting the sewer, all parcels receive the same capacity benefit, and not all parcels front le sewer. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, :alifornia, as follows: 1. This work was in response to a request from many of the property owners in this area of the City. During this time we held two informal meetings with property owners in March and June of 2001 at the City's office on Faraday Avenue to discuss the proposed public sewer. Based on input from the property owners, the City has determined the service area for the public sewer and a method to finance the construction cost. The service area includes twenty owners. Seven property owners have an existing residence and seven property owners own (20) parcels of land as shown on the attached Exhibit A. There are a total of 14 property parcels that are undeveloped. Our records show that you own at least one of these twenty parcels. SEWER REIMBURSEMENT CONNECTION FEE The estimated construction cost of the sewer project is shown on Exhibit B and totals $420.000. To finance the project's construction cost, it is proposed that the City borrow from its Sewer Replacement Fund. The benefiting property owners would .then reimburse the Sewer reimbursement connection fee for each of the 20 parcels by prorating the project cost by a ratio Replacement Fund through a "Reimbursement Connection Fee". We have calculated the of the number of equivalent dwelling units (EDU's), which is a single-family residence, that can be built on a given parcel of land divided by the total number of EDU's in the benefit area. The number of EDU's were estimated by using the City's existing land use zoning. This approach resulted in a potential for 28 EDU's on 20 parcels of land. The distribution of cost to each parcel of land is shown on Exhibit C. A parcel having one EDU or residence would have a reimbursement connection fee of $15,000. In addition to this fee, the property owner is also approximately $1,800 per EDU. responsible to pay the City's sewer connection fee that pays for treatment capacity. This fee is TIME FOR PAYMENT OF REIMBURSEMENT CONNECTION FEE Property owners with developed property would be required to pay their fee assessment at the time they connect to the sewer, The City Engineer will not be requiring existing residences to connect to the sewer unless their private on-site septic tanklleachfield system fails. Owners of undeveloped property would be required to pay the fee assessment upon issuance of a building permit for the property. These conditions would be recorded on each property. The City Council considered the proposal to establish a sewer reimbursement connection fee in relation to Chapter 13.08 of the Carlsbad Municipal Code. This Chapter establishes provisions to compel a property owner to pay such owner's proportionate share of the cost of a sewer main to serve such owner's property as a precondition to connecting to such sewer main. Before the City can establish the sewer reimbursement connection fee, it must comply with the Code Section 66016 requires that prior to adopting the resolution to levy such sewer provisions of California Government Code Section 66013 and 66016.
