RECOMMENDED ACTION:
Adopt Ordinance No. NS-621 of the Carlsbad Municipal Code by the addition of Section
10.44.680 to establish a prima facie 40 mile per hour speed limit upon Black Rail Road from
Aviara Parkway to its intersection with Sapphire Drive.
ITEM EXPLANATION:
Ordinance No. NS-621 was introduced and first read at the City Council meeting held on
February 19, 2002. The second reading allows the City Council to adopt the ordinance,
which would then become effective in thirty days. The City Clerk will have the ordinance
published within fifteen days, if adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF
THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION 10.44.680 TO ESTABLISH A PRIMA FACIE 40 MILE PER HOUR
SPEED LIMIT UPON BLACK RAIL ROAD FROM AVIARA PARKWAY
TO ITS INTERSECTION WITH SAPPHIRE DRIVE.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
by the addition of Section 10.44.680 to read as follows:
'10.44.680 Black Rail Road. Upon Black Rail Road from Aviara Parkway
to its intersection with Sapphire Drive, the prima facie speed limit shall
be forty miles per hour."
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and
le City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to
le published at least once in a newspaper of general circulation in the City of Carlsbad within
fteen (1 5) days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the

PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
leld on the 5th day of MARCH , 2002 by the following vote, to wit:
