RECOMMENDED ACTION:
Adopt Resolution No. ma-oq? summarily vacating two irrevocable offers of dedication for
street and utility purposes and two irrevocable offers of dedication for temporary construction related
to the construction of the realignment of Rancho Santa Fe Road (STV 01-10), CT 99-04.
ITEM EXPLANATION:
In 1998, the Arroyo La Costa project was conditioned to ensure the construction of future Rancho
Santa Fe Road. Real Estate Collateral Management Company, the Arroyo La Costa property
owner, executed two Irrevocable Offers of Dedication for Public Street and Public Utility Purposes
and two Irrevocable Offers of Dedication for Temporary Construction Areas for Drainage Structures,
Excavation and Embankment Slopes, Temporary Material Storage, Street Detours and Other Uses
Related to Construction of the Realignment of Rancho Santa Fe Road. The Irrevocable Offers of
document numbers 1998-0152408, 1998-0152409, 1998-0152410 and 1998-0152411.
Dedication were recorded with the San Diego County Recorder's Office March 20, 1998, as
The City recently completed construction plans for Rancho Santa Fe Road. The alignment of the
roadway differs slightly from what was anticipated when the 1998 easements were recorded.
Real Estate Collateral Management Company owns the property now known as the Villages of La
Costa where Rancho Santa Fe Road will be realigned. The Villages of La Costa tentative map,
which was approved by City Council in October 2001, considered vacation of the existing
easements and dedication of new easements for the ultimate location of Rancho Santa Fe Road.
The property owner has prepared and executed new easements for road and public utility purposes
which encompass Rancho Santa Fe Road as currently designed. These new easements have been
reviewed by staff sent for recordation.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, SUMMARILY VACATING TWO
IRREVOCABLE OFFERS OF DEDICATION FOR STREET AND
UTILITY EASEMENTS AND TWO IRREVOCABLE OFFERS OF
THE CONSTRUCTION OF THE REALIGNMENT OF RANCHO
DEDICATION FOR TEMPORARY CONSTRUCTION RELATED TO
SANTA FE ROAD (STV 01-10), CT 99-04.
II WHEREAS, Real Estate Collateral Management Company, a Delaware Corporation, has
submitted an application to vacate four irrevocable offers of dedications; and
WHEREAS, the offers were recorded with the San Diego County Recorder's Office March
20, 1998, as document numbers 1998-0152408, 1998-0152409, 1998-0152410, and 1998-
0152411; and
WHEREAS, the tentative map of Carlsbad Tract CT 99-04 contemplated the realignment
and vacation of existing easements; and
WHEREAS, the tentative map of Carlsbad Tract 99-04 with conditions, was approved by
the Planning Commission on September 5, 2001, pursuant to Resolution No. 5020; and
WHEREAS, the City Engineer has determined that the easements are not needed for
present or future street or utility purposes; and
WHEREAS, the proposed vacation is in accordance with the Growth Management Policies
and is consistent with the General Plan of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. It is said Council's intention to summarily vacate the four irrevocable offers of
dedication previously granted to the City and recorded in the Office of the County Recorder as
document numbers 1998-0152408, 1998-0152409, 1998-0152410, and 1998-0152411.
3. That pursuant to Division 9, Part 3, Chapter 4 of the California Streets and
Highways Code, said easements more particularly described in Exhibits A, and shown for the
sake of clarity on Exhibits 8, be summarily vacated.
4. That the City Clerk is directed to record this resolution in the Office of the County
Recorder of San Diego County.
5. From the date the resolution is recorded in the County Recorder's Office, the area
vacated no longer constitutes an easement for street and utility purposes.
