TITLE:
RESOLUTION OF ACCEPTANCE, FOR PUBLIC STREET
DEPT. HD.
RECOMMENDED ACTION:
Adopt Resolution No. SWdW accepting a portion of Lot 112, Map No. 9959, for public street
purposes.
ITEM EXPLANATION:
The final map for Carlsbad Tract No. 75-9 (B) was recorded as Map No. 9959 on December 31,
1980, in the Office of the County Recorder of San Diego County as file number 80-440244.
The subdivider of Map 9959 offered to dedicate a portion of a lot (Lot number 112) for public street
purposes. The portion of Lot 112 offered for dedication was at the easterly terminus of Avenida
Diestro. The City Council rejected said offer of dedication at the time of map recordation.
The Villages of La Costa Tentative Map, CT 99-04, which was approved by City Council on October
23, 2001, proposed the extension of Avenida Diestro from its current terminus into Planning Area
3.15 as shown on said Tentative Map.
In order to extend Avenida Diestro as a public street into Planning Area 3.15, the City needs to
accept the offer of dedication previously rejected on Map No. 9959.
FISCAL IMPACT:
No fiscal impact to the City.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD. CALIFORNIA, ACCEPTING A DEDICATION FOR
PUBLIC STREET PURPOSES OVER A PORTION OF LOT 112,
MAP NO. 9959
WHEREAS, Map No. 9959 recorded in the Office of the San Diego County Recorder on
December 31, 1980, as file No. 80-440244; and
WHEREAS, a portion of lot 112 as shown on Map No. 9959 was offered for public street
purposes; and
WHEREAS, the City rejected the offer of dedication as offered on said map was; and
WHEREAS, Section 66477.2 of the Government Code of the State of California states that
rejected offers of dedication for street purposes remain open and subject to acceptance unless
vacated in accordance with Part 3 of Division 9 of the Streets and Highways Code; and
WHEREAS, the City Council did on October 23, 2001, adopt Resolution No. 2001-318
approving the Villages of La Costa tentative map No. CT 99-04; and
WHEREAS, the tentative map of Carisbad Tract CT 99-04 considered the extension of
Avenida Diestro easterly into Planning Area 3.15 as shown on the tentative map; and
WHEREAS, in order to connect Avenida Diestro from its current terminus into Planning
Area 3.15 as shown on CT 99-04, the City must accept the offer of dedication for public street
purposes over that portion of Lot 112 of Map 9959.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. It is said Council's intention to accept, for public street purposes, that portion of Lot
11 2, Map No. 9959, previously dedicated as such and rejected by the City on said map.
