ARTS ON DONATION OF ARTWORK MTG. 4/02/02 TITLE: DISCUSSION ENTITLED “AMERICA” RECOMMENDED ACTION: CITY MGR City Council take action as it deems appropriate after discussion on the donation of artwork, “AMERICA” by artist Paul Weber. ITEM EXPLANATION: Artist Paul Weber is interested in donating the artwork “AMERICA” to the City of Carlsbad. At the November 5, 2001 City Council meeting, Arts Commissioner Bill Lignante asked Council directly to consider accepting “AMERICA” and place it at the former Split Pavilion site. City Council returned the request to the Arts Commission and asked for its recommendation. The Arts Commission held a special meeting on November 26,2001 to discuss the request. During this meeting Commissioner Lignante motioned, and the Arts Commission voted, to accept the sculpture on a temporary basis for a period of one year. Commissioner Lignante also motioned to place the sculpture at the former Split Pavilion site. Recognizing the sensitivity of this area, the Arts Commission voted to place the artwork proposal on public review at both Carlsbad libraries for a period of one week in order to obtain feedback from the community before making a decision at its December 6 meeting. Commissioner Lignante’s motion to place the sculpture at the former Split Pavilion site was tabled until the December 6 meeting. During the December 6 Arts Commission meeting, the Commission reviewed the public comment response from the community that showed 29% in favor of the location and 71 % opposed. The Commission also heard testimony from several members of the community who were opposed to placing the artwork at this location. Housing and Redevelopment Director Debbie Fountain also explained to the Arts Commission a Coastal Commission permit was required to place the sculpture at the site and outlined the process and time involved to obtain the permit. Commissioner Lignante withdrew his motion to place the artwork at the former Split Pavilion site. The Arts Commission formed an ad hoc committee to review all potential sites in the City and report back to the Commission at its next meeting. Ad hoc committee members Scott Rutledge and Jeri Held of the Arts Commission, and Carlsbad discuss the sites. The committee unanimously concluded to recommend the Arts Commission residents Bob Richards, Barbara Hamilton and Rita Francis met January 15, 2002 to review and approve placement of “AMERICA at the Cole Library. The committee’s recommendation was presented to the Arts Commission at its February 7, 2002 meeting. On motion by Commissioner Jeri Held, the Arts Commission approved recommending to City Council it accept the donation of the artwork entitled “AMERICA” by artist Paul Weber for a period of one year and install it at the Cole Library. Subsequent to the Arts Commission meeting, the Library Board of Trustees, at its regular meeting on too large for the site. It was learned after the March Arts Commission meeting that artist Paul Weber was not in favor of placing his arhvork at the Farmers building site and he intended to attend a Council meeting to request the City Council act on his donation.
