CONSTRUCTION OF THE CHESTNUT AVENUE
APPROPRIATION OF FUNDS
RECOMMENDED ACTION:
Adopt Resolution No. 2002-106 accepting bids and awarding the construction contract for the
Chestnut Avenue Parkway Improvements, Project No. 3851, and appropriation of funds.
ITEM EXPLANATION:
In 1999, a new sidewalk was constructed along the southerly side of Chestnut Avenue from
El Camino Real to 300 west of Donna Drive. The sidewalk project resulted in the roadway being
widened on the south side between El Camino Real and Cameo Road. In widening the roadway,
the ground elevation adjacent to the first three residential properties east of El Camino Real was
raised resulting in a loss of privacy in their backyards. To restore their privacy, the subject project
installs a low retaining wall, a seven-foot privacy fence, and landscaping along the southerly
parkway of Chestnut Avenue.
During the design phase of the project, staff conducted meetings with the property owners to define
the scope and type of improvements to be installed. The property owners are supportive of the plans
as proposed. To facilitate the construction of the improvements, the property owners have signed
“Permission for Right of Entry” forms that grant the City permission to enter their backyards adjacent
to Chestnut Avenue.
On December 18, 2001, the City Council authorized the advertisement for bids for construction of
the proposed improvements. The Engineer’s Estimate for the construction of the project was
$50,000. Four (4) bids were received on March 7, 2002 which are summarized on Table 1.

After a review of the bids, it is apparent that the Engineer’s Estimate did not anticipate the impact of
the relatively small project size on the bid prices. The plans do not contain any ambiguities nor were
any questions received from prospective bidders that would indicate that re-advertising the project
would result in lower bids.
With a bid of $71,100, Sean Malek Engineering is the lowest responsive bidder. All bid documents
provided by Sean Malek Engineering and Construction, Inc.. are in order.

FISCAL IMPACT:
The total estimated construction costs for the project are summarized in Table 2.

To provide sufficient funds for the construction phase of the project, engineering is
recommending the appropriation of an additional $3,875 in General Capital Construction funds.
ENVIRONMENTAL IMPACTS:
This project is categorically exempt from the environmental review process under Section 15301
Class 1 (C) of the Public Resources Code (California Environmental Quality Act).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
THE CONSTRUCTION CONTRACT FOR THE CHESTNUT
AVENUE PARKWAY IMPROVEMENTS, PROJECT NO. 3851,
AND APPROPRIATION OF FUNDS.
WHEREAS, plans and specifications have been approved by the City Council of
the City of Carlsbad for the construction of the Poinsettia Lane Overhead Widening,
Project Nos. 3551,3442,3829, and 3810; and
WHEREAS, the low bid received to construct said project submitted by Sean Malek
Engineering and Construction, Inc., is responsive; and
WHEREAS, the total estimated costs for construction of the project is $88,875; and
WHEREAS, to fund the construction of the project requires additional appropriations in the
amount of $3,875 from the General Capital Construction fund
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Finance Director is authorized to appropriate additional funds in the
amount of $3,875 from the General Capital Construction fund to the project account.
3. That the bid of $71,100 by Sean Malek Engineering and Construction, Inc., for the
Chestnut Avenue Parkway Improvements, Project No. 3851, is accepted and the Mayor is hereby
authorized to execute a contract therefore.
4. That the City Manager is hereby authorized to approve construction change orders
up to $10,665 for Project No. 3851.

5. That the award of this contract is contingent upon Sean Malek Engineering and
:onstruction, Inc., executing the required contract and submitting the required bonds and
nsurance policies, as described in the contract, within twenty (20) days of adoption of this
,esolution. The City Manager may grant reasonable extensions of time.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
leld on the 9th day of APRIL , 2002 by the following vote, to wit:
