FIN AND SPA CORPORATION FOR CITY MG~ [ECOMMENDED ACTION: Adopt Resolution No. 2002-107 authorizing a refund to the La Costa Hotel and Spa Corporation of $16,596.90 in business license tax. TEM EXPLANATION: The La Costa Hotel and Spa Corporation sold their resort to KSL La Costa Resort Corporation on November 15, 2001. The La Costa Hotel and Spa Corporation had renewed their business license in October 2001, and paid its business license tax for the full year. On January 22, 2002, the new company, KSL La Costa Resort Corporation applied for a new business license, and subsequently paid their business license tax for the entire year. The La Costa Hotel and Spa Corporation has requested a refund for the period of time after they sold the resort. The Finance Department: 1) confirmed the date that the La Costa Hotel and Spa Corporation ceased conducting business in the City; 2) audited the refund request by reviewing the financial statements of the La Costa Hotel and Spa Corporation for the period of the business license tax payment and confirming the refund amount; and 3) verified that the new company (KSL La Costa Resort Corporation) had applied and paid for a business license with the City. Therefore, staff is recommending approval of a refund to the La Costa Hotel and Spa Corporation for $16.596.90. Summarv Section 5.04.130 of the Carlsbad Municipal Code requires Council approval of any refund in excess of $500. Therefore, staff is recommending approval of a refund to the La Costa Hotel and Spa Corporation for $16,596.90. :ISCAL IMPACT: The refund of $16,596.90 to the La Costa Hotel and Spa Corporation will result in a reduction in business license revenue for fiscal year 2001-2002, which will be offset by the business license taxes paid by the new owner. There is no net fiscal impact. iXHIBIT: 1. Resolution No. 2002-107 , Refunding Business Tax Payment to the La Costa Hotel and Spa Corporation. 1 2 3 4 5 6 7 8 9 la 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2002-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, TO THE LA COSTA HOTEL AND SPA CORPORATION REFUNDING BUSINESS TAX PAYMENT WHEREAS, the La Costa Hotel and Spa Corporation sold their resort on November 15, 2001 and the company has requested a refund for the period of time after they stopped conducting business in the City; and WHEREAS, the sale of the resort was made to a new company under the name of KSL La Costa Resort Corporation; and WHEREAS, the Finance Department confirmed the date the La Costa Hotel and Spa Corporation ceased doing business in the City, audited and verified the refund amount, and verified that the new company (KSL La Costa Resort Corporation) applied and paid for a business license. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad. California, as follows: SECTION 1. That the above recitals are all true and correct.
