RECOMMENDED ACTION:
That the City Council ADOPT Resolution No. 2002-129 APPROVING the Amendment No.
5 to the agreement Professional Services Agreement for building inspection services for various
Drojects under construction within the City of Carlsbad.
ITEM EXPLANATION:
The City uses a mix of full time, part time, and contract building inspection services. Building
Inspection request levels have continued through fiscal year 2001-02 for permits issued in prior
fears. The contract for building inspectors, hired through Kleinfelder and Associates was set at
$125,000. This contract was amended to allow a maximum of $225,000 upon Council approval.
There is a need to amend the contract to increase the contract capacity an additional $100,000. This
till carry the remaining workload in the fiscal year. At that point, it is anticipated the contract services
will no longer be needed.
FISCAL IMPACT:
There is adequate funding for Miscellaneous Professional Services in the Building Department
budget for the remainder of fiscal year 2000-01. The Miscellaneous Professional Services Account
in the Building Department will be utilized to pay for contract inspection services on an as-needed
basis. No additional budget action is required for this contract amendment.
ENVIRONMENTAL:
The Planning Director has determined that the activities that are the scope of the contract are
categorically exempt from CEQA review pursuant to Section 15309 of the CEQA Guidelines. A
Notice of Exemption will be filed upon approval of the contract.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING AN
AMENDED AGREEMENT BETWEEN THE CITY OF
CARLSBAD AND KLEINFELDER, INCORPORATED FOR
BUILDING INSPECTION.
WHEREAS, the City Council of the City of Carlsbad has determined it necessary.
desirable and in the public interest to provide building inspection services as an element of the
construction process for projects under construction within the City of Carlsbad: and
WHEREAS, staff bas determined that two contract field inspectors are required to meet
the demand for field inspection services: and
WHEREAS, the current amended contract with Kleinfelder and Associates Incorporated
has a contract limit of $225,000; and
WHEREAS; staff bas determined that the contract limit must be raised an additional
$1 00.000 to provide two field inspectors for the remaining fiscal year;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California as follows:
1. That the above recitations are true and correct
2. That the amended Agreement for Professional Services between the City of Carlsbad
and Kleinfelder, Incorporated to provide building inspection services is approved, and the Mayor
and City Clerk are authorized and directed to execute the same on behalf of the City.

AMENDMENT NO. 3 TO AGREEMENT FOR INSPECTOR SERVICE
Kleinfelder, Inc.
This Amendment No. 5 is entered into and effective as of the /b7/f day of
"Agreement") by and between the City of Carlsbad, a municipal corporation, ("City"),
and Kleinfelder, Inc., ("Contractor") (collectively, the "Parties") for an inspection services
contractor to provide necessary inspections for construction projects within the City.

RECITALS
A. On September 13, 1999, the Parties executed Amendment No. 1 to the
Agreement to allow for additional year for inspections services; and
A. On April 14, 2000, the Parties executed Amendment No. 2 to the Agreement
to allow for additional services for construction inspections; and
B. On June 27,2000, the Parties executed Amendment No. 3 to the Agreement
to allow for additional services for construction inspections; and
D. On September 29, 2000, the Parties executed Amendment No. 4 to the
Agreement to allow for additional year for inspection services; and
E. The Parties desire to alter the Agreement's scope of work to allow for
additional services for construction inspections; and
F. The Parties have negotiated and agreed to a supplemental scope of work and
fee schedule, which is attached to and incorporated by this reference as Exhibit "A,
Scope of Services and Fee.
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained herein, City and Contractor agree as follows:
1. In addition to those services contained in the Agreement, as may
have been amended from time to time, Contractor will provide those services described
in Exhibit "A.
2. City will pay Contractor for all work associated with those services
described in Paragraph 1 above on a time and materials basis not-to-exceed One
Hundred Thousand dollars ($100,000). Contractor will provide City, on a monthly basis,
copies of invoices sufficiently detailed to include hours performed, hourly rates, and
related activities and costs for approval by City.
3. Contractor will complete all work as designated by the Principal
Building Inspector by expiration of the agreement amended hereby.
4. All other provisions of the Agreement, as may have been amended
from time to time, will remain in full force and effect.

5. All requisite insurance policies to be maintained by Contractor
pursuant to the Agreement, as may have been amended from time to time, will include
coverage for this Amendment.
6. The individuals executing this Amendment and the instruments
referenced in it on behalf of Contractor each represent and warrant that they have the
legal power, right and actual authority to bind Contractor to the terms and conditions of
this Amendment.
