RECOMMENDED ACTION:
That the City Council ADOPT Resolution No. 2002-149 , AUTHORIZING Ladwig Design
Group to prepare an Amendment to the Local Facilities Management Plan for Zone 15 on behalf of
the developers for the Cantarini Ranch and Holly Springs projects.
ITEM EXPLANATION:
Carlsbad Municipal Code Section 21.90.120 describes the procedures for preparation of a Local
Facilities Management Plan (LFMP). In a zone where there are multiple owners, the owners may
jointly submit a plan. However, if all of the owners in a zone do not consent to the preparation of a
plan, one or more owners may petition the City Council for permission to prepare the plan. The
process for amending a plan is the same as for preparation.
In the present case, David Bentley is currently processing plans for the development of the Cantarini
Ranch property, owned by Banning and Carol Cantarini. Lucia Sipple is the owner of the Holly
Springs property which has also been submitted for review of a proposed subdivision. These
properties are contiguous and are dependent upon each other for their circulation systems.
Together, these properties comprise approximately 257 acres of the 1,227 acres in the Zone 15
plan.
The plan for Zone 15 was approved in 1990 and amended in 1997 and 1998. Twelve of the 19
owners of undeveloped property in the zones have consented to the preparation of the LFMP
amendment. However, one owner has not consented and replies were not received from the
remaining six property owners. Therefore, Ladwig Design Group has written a letter to the City
(Exhibit 3) requesting permission to prepare an amendment for the Zone 15 LFMP.
Staff supports Ladwig Design Group's request because it is necessary to have the Local Facilities
Management Plan amendment processed concurrently with the joint EIR for CantarinilHolly Springs
and the associated development proposals that are currently under review.
FISCAL IMPACT:
Section 21.90.120 states that a limit based on the estimated cost of the plan shall be determined at
the time of the hearing. This code section does not apply in this instance since the developer is not
expecting reimbursement from fees passed on to other property owners in the zone. The applicant
will bear all costs related to preparation of the Zone 15 LFMP amendment. In addition, the applicant has paid the required processing fee for an LFMP amendment. There will be no fiscal impact to the
City.

The City Council of the City of Carlsbad. California, does hereby resolve a!
follows:
WHEREAS, Carlsbad Municipal Code Section 21.90.120 specifies tht
procedures for preparation of a Local Facilities Management Plan when joint submission by al
property owners is not feasible; and
WHEREAS, there are nineteen property owners within the boundaries of Zonf
15; and
WHEREAS, there is not unanimous consent among the property owners in Zone
15 for preparation of the pian amendment; and
WHEREAS, Ladwig Design Group, agent for the Cantarini Ranch and Holl)
Springs developments has formally petitioned the City Council to authorize preparation of ar
amendment to the Zone 15 Local Facilities Management Plan.

Dear Barbara:
Enclosed is a check in the amount of $5,000 for the initial deposit to begin the process of an LFMP
Amendment for Zone 15. As you recall, if we do not have 100% consent from all of the landowners
within Zone 15 to prepare the plan that the Code requires us to work through you and submit to the
Council for their approval to prepare the LFMP Amendment with the understanding that my client
would pay for the cost of the amendment.
Late last year, I did try to obtain approvals from the owners within Zone 15 and I am enclosing
copies of those letters. We did receive specific responses from a number of the owners, but there
were a number of them that never responded, along with one individual, Mrs. Kato, who says she
does not want to proceed with the amendment. Please look these letters over along with the exhibits
that I have attached that shows the people who have responded.
I also spoke with Don Rideout a number of months ago and the first thing that Don would like us
to do is prepare a constraints analysis and buildout calculations for the zone and turn that in to you
and Don to review prior to getting into any major changes to the plan itself. I will begin the
preparation of that information and I would think that by the time the Council has considered our
request to do the amendment that I should have that information available.
