RECOMMENDED ACTION:
Adopt Resolution No. 2002-162 to approve and authorize the acquisition of easements
from the Daybreak Community Church for Poinsettia Lane Reach C, Project No. 3674.

ITEM EXPLANATION:
Reach C of Poinsettia Lane extends from Black Rail Road easterly towards Ambrosia Lane.
the property owners must dedicate easements to the City of Carlsbad. The road alignment crosses three private properties. To enable construction of Reach C,
The improvement plans for this segment of Poinsettia Lane are complete. The plans include grading, major arterial roadway, landscaped median, storm drain, sewer, water and recycled water system improvements. The easement descriptions and configurations have been generated in conjunction with the development of these plans.
The Daybreak Community Church of Coastal North County owns the property along the easterly portion of the south side of the proposed roadway centerline. Prior to constructing the roadway, the City must acquire permanent roadway, drainage and slope easements, as well as a temporaly construction easement from the Church.
Based on property appraisals, the City made an offer to acquire the easements for a total amount of
$62,572. Daybreak Community Church made a counteroffer requesting additional compensation.
After discussions with the City Council, staff has negotiated an agreement that consists of the
following items: 1) A payment of $62,572 for the easements; 2) Daybreak Community Church is
responsible for paying one-half the cost of the Poinsettia Lane frontage improvements along their
property with a maximum cost share of $30,000. The Church will pay their half of the frontage
improvement costs at the time any City permit is obtained for their property; 3) If the elevation of the
ground on the Church property is lowered upon its development reducing the required slope easement, the Church shall pay the City an amount equal to the City’s cost for purchase of that

portion of the easement no longer needed, which shall be quitclaimed back to the Church;

The potential impacts of the construction of this portion of Poinsettia Lane have been reviewed consistent with the California Environmental Quality Act which resulted in the certification on the Environmental Impact Report for the Zone 20 Specific Plan (EIR 90-03). In addition, the Mitigated Negative Declaration for the De Jong residential project (CT 98-05) issued on November 30, 1998, supported the findings of EIR 90-03.

The Planning Director determined that the environmental effects of this project have already been considered in conjunction with the previously mentioned environmental documents and, therefore, no additional environmental review is required. A public Notice of Prior Environmental Compliance was published on Januaty 6, 1999, and a Notice of Determination was filed immediately thereafter.
FISCAL IMPACT:
The cost of the easements from the Daybreak community Church of Coastal North County is
$62,572. The estimated cost of the Poinsettia Lane frontage improvements across the Church property is $37,000, half of which would be $18,500. Assuming the actual costs of the frontage
for the easements and frontage improvements would be $81,072 ($62,572 + $18,500 = $81,072).
improvements turn out to be $37,000, the effective compensation to Daybreak Community Church
Sufficient Bridge and Thoroughfare District No. 2 (BTW2) funds are currently available in the project
account to purchase the subject easements. The cost of the frontage improvements is part of the
construction phase of the project to be paid at a later date.

DEED OF EASEMENT
This is to certify that the interest in real property conveyed by the Corporation
Grant Deed of Easement dated April 19, 2002, from Daybreak Community Church of
Coastal North County, a California non-profit religious corporation, to the City of
Carlsbad, a Municipal Corporation, is hereby accepted by the City Council of the City of
Carlsbad, California, pursuant to Ordinance No. NS-422, adopted on September 16,
1997, and the grantee consents to the recordation thereof by its duly authorized officer.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, TO APPROVE AND AUTHORIZE
ACQUISITION OF EASEMENTS FROM THE DAYBREAK COMMUNITY
CHURCH OF COASTAL NORTH COUNTY FOR POINSETTIA LANE
REACH C. PROJECT NO. 3674.
WHEREAS, the City of Carlsbad has designed Poinsettia Lane Reach C to extend from
Black Rail Road to just west of Ambrosia Lane; and
WHEREAS, Poinsettia Lane Reach C is located across private property owned by the
Daybreak Community Church of Coastal North County; and
WHEREAS. permanent roadway, drainage and slope easements and a temporary
construction easement are required to be obtained from Daybreak Community Church of Coastal
North County to construct, operate and maintain the roadway; and
WHEREAS, the City has prepared the required grant deed, legal description and plat for
the easements and offered the Daybreak Community Church of Coastal North County the sum of
$62,572 for the easements; and
WHEREAS, the Daybreak Community Church of Coastal North County has agreed to
accept the City's offer of $62,572 plus they will pay for .one-half the costs of the Poinsettia Lane
frontage improvements across APN:215-080-04 with a maximum cost of $30,000 with the
payment occurring at the time any City permit is obtained for APN:215-080-04; and
WHEREAS, the Daybreak Community Church of Coastal North County has agreed to
pay the City' to quitclaim back to the Church any portion of the easement on Parcel 4 of
APN: 215-080-04 no longer needed, should the Church adjust ground levels on the parcel upon
11 its future development reducing the required slope easement, the amount the City paid for its
purchase of that portion of the easement; and
WHEREAS, there are sufficient funds available to obtain the easement.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

2. That the attached grant deed be approved and accepted and the City Clerk is
lirected to attach her certificate of acceptance and cause the deed to be recorded in the office of

WATERLINES BEING CONSTRUCTED AS PART OF POINSETTIA EXISTING WATERLINE EASEMENT AFTER ACCEPTANCE OF THE
LANE REACH C. PROJECT NO. 3674.
WHEREAS, Poinsettia Lane Reach C and the associated waterline improvements are
located across private property owned by the Daybreak community Church of Coastal North
County; and
WHEREAS, permanent roadway, drainage and slope easements and a temporary
construction easement are required to be obtained from Daybreak Community Church of Coastal
North County to construct, operate and maintain Poinsettia Lane Reach C; and
WHEREAS, after construction of the waterlines included in the Poinsettia Lane Reach C
project are accepted, the existing waterline across APN: 215-080-04 will be removed from service
and the waterline easement across APN: 215-080-04 will no longer be needed.
NOW,.THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Carlsbad Municipal Water District (CMWD) will quitclaim the existing
waterline easement across parcel Zl5-080-04 after the CMWD accepts the new relocated
waterline being constructed as part of the Poinsettia Lane Reach C project.
