HD.& TITLE: IEPT. HR CLAIM OF STEVEN FORMAN IECOMMENDED ACTION: Approval of Resolution No. 2002-213 approving the Findings and Award, which authorizes the payment of $29,750.00 to Steven Forman. ITEM EXPLANATION: The claimant is a former Senior Police Officer with the City of Carlsbad Police Department. He was hired by the City on November 3, 1975. Mr. Forman sustained an industrial injury on April 8,2001 to his lower back due to his normal police activities. The terms and conditions of the settlement are set forth in the Findings and Award (on file in the Human Resources Department). The terms and conditions were agreed upon by the City of Carlsbad and approved by TRISTAR, the City’s Third Party Administrator, and the Workers’ Compensation Appeals Board. FISCAL IMPACT: The cost of the settlement is $29,750.00 payable at the rate of $170 weekly and the provision of future medical treatment. There are sufficient funds available in the Workers’ Compensation Self-Insurance Fund to cover the cost of this settlement. EXHIBITS: 1. ResolutionNo. 2002-213 I 1 2 3 4 5 6 7 0 9 10 11 12 13 14 15 16 17 10 19 20 21 22 23 24 25 26 27 20 .- RESOLUTION NO. 2002-213 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE EXPENDITURE OF FUNDS FOR SETTLEMENT OF THE WORKERS’ COMPENSATION CLAIM OF STEVEN FORMAN WHEREAS, TRISTAR, third party administrator for the City of Carlsbad in this matter has recommended a settlement of the Workers’ Compensation claim of Steven Forman; and WHEREAS, the settlement has been approved by the Workers’ Compensation Appeals Board; and WHEREAS, there are sufficient funds available in the Workers’ Compensation Self- Insurance Fund to pay the settlement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the expenditure of $29,750.00 from the Workers’ Compensation Self- Insurance Fund is authorized for the settlement of said claim. That the City Council accepts the Findings and Award on file in the Human Resources Department.
