RECOMMENDED ACTION:
Adopt Resolution No. 2002-240 approving plans and specifications and authorizing the
City Clerk to advertise for bids for the construction of Poinsettia Lane Reach "C" and Domestic
and Recycled Water Transmission Mains, Project Nos. 36731, 35851, and 36752.

36752.
ITEM EXPLANATION:
The project includes an extension of Poinsettia Lane between Black Rail Road and Ambrosia
collector sewer, and storm drain. Poinsettia Lane is a major arterial roadway in the City's Master
Lane, installation of domestic water transmission mains, recycled water transmission mains,
already obtained the necessary roadway easements from three adjacent property owners. The
Plan and the 1,400-foot extension is part of Bridge and Thoroughfare District No. 2. The City has
improvements include a four-lane roadway with landscaped median, bike lanes, and street lights.
The domestic water transmission mains include 30", 24, 16", and 12" pipelines installed as part of
CMWD's Water Master Plan. The recycled water transmission mains include 24" and 18 pipelines
to be installed as part of the Phase II Recycled Water System. The collector sewer will be 725
feet of 8" PVC and the storm drain will be 750 feet of reinforced concrete pipe.
ENVIRONMENTAL REVIEW:
The potential impacts of the construction of this portion of Poinsettia Lane have been reviewed consistent with the California Environmental Quality Act which resulted in the certification on the
Environmental Impact Report for the Zone 20 Specific Plan (EIR 90-03). In addition, the Mitigated Negative Declaration for the De Jong residential project (CT 98-05) issued on November 30, 1998,
supported the findings of EIR 90-03.
The Planning Director determined that the environmental effects of this project have already been
considered in conjunction with the previously mentioned environmental documents and, therefore,
no additional environmental review is required. A public Notice of Prior Environmental Compliance
was published on January 6, 1999, and a Notice of Determination was filed immediately thereafter.
The Coastal Development Permit 98-26 was approved in Planning Commission Resolution
No. 4508.
FISCAL IMPACT:
The project will be funded through a variety of fund sources. The domestic water mains will be funded from Water Connection Fees (CIP #35851). The recycled water mains will be funded by
the Encina Basin Water Reclamation Program, Phase II Project (CIP #36752). The sewer and
road frontage improvements adjacent to the DeJong property and Redeemer by the Sea Church
property will be paid for with developer deposits, which will be obtained prior to award of the construction contract.

The frontage improvements adjacent to the Daybreak Church property will be funded from Bridge
and Thoroughfare District No. 2 (B&TD #2) fee revenues as part of the consideration for the
the City for one-half of their frontage improvement costs at the time they obtain permits to develop acquisition of the road easement along their property frontage. Daybreak Church will reimburse
their property.
The road grading work, middle two traffic lanes, median curbs, and storm drain improvements will be
funded by B&TD #2 fee revenues. Council previously approved a loan to BTD #2 from the General Fund for $500,000 and a loan from the Gas Tax Fund for $2.5 million. These loans paid for the School
obligations for the road improvements could be paid. The fees for B&TD #2 were recently increased,
District's share of the road improvements ($1.5 million) as well as provided cash flow so that current
however, there still are insufficient funds available in B&TD #2 to build Reach "C of Poinsettia Lane.
Approximately $1.3 million is currently available in B&TD #2 for this project. As a result, the City will
need to loan B&TD #2 approximately $500,000 from the General Capital Construction Fund. The loan and appropriation of B&TD #2 funds will be requested at the time of bid award. Assuming the adjacent
land develops as planned, the loan will be repaid as the B&TD #2 fees are collected.
The estimated construction costs and funding sources for each of these improvements are shown
in the following table:

Council recently appropriated $15.8 million to construct Phase I1 Recycled Water Pipelines and the
domestic water pipelines have $1.6 million remaining appropriation; therefore, sufficient funds are available to construct the domestic and recycled water transmission mains.

SPECIFICATIONS AND AUTHORIZING THE CITY CLERK TO
ADVERTISE FOR BIDS FOR THE CONSTRUCTION OF

WHEREAS, the City Council of the City of Carlsbad, California, has determined it
necessary, desirable and in the public interest to construct Poinsettia Lane Reach "C" and
Domestic and Recycled Water Transmission Mains, Project Nos. 36731, 35851, and 36752; and
WHEREAS, the plans and specifications for furnishing of all labor, materials, tools,
equipment, transportation, and other expenses necessary or incidental to this project have been
prepared and are on file in the Public Works-Engineering Department of the City of Carlsbad and
are incorporated herein by reference; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the plans, specifications, and contract documents on file in the Public Works-

WHEREAS, the Board of Directors of Carlsbad Municipal Water District (CMWD) of the
City of Carlsbad, California, has determined it necessary, desirable and in the public interest to
construct Poinsettia Lane Reach "C" and Domestic and Recycled Water Transmission Mains,
Project Nos. 36731,35851, and 36752; and
WHEREAS, the plans and specifications for furnishing of all labor, materials, tools,
equipment, transportation, and other expenses necessary or incidental to this project have been
prepared and are on file in the Public Works-Engineering Department of the City of Carlsbad and
are incorporated herein by reference; and
WHEREAS, funds in the amount of $15.8 million have been previously appropriated to
construct the recycled water pipelines, and funds in the amount of $1.6 million are available and
have been previously appropriated to construct the domestic water pipelines; therefore, sufficient
funds are available to construct the domestic and recycled water transmission mains; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:
