HD. CITY MGR. RECOMMENDED ACTION: Specify the City Council members authorized to submit arguments regarding the expenditure limitation and adopt Resolution No. 2002-230 and Resolution No. 2002- 233. ITEM EXPLANATION: At its meeting of Tuesday, July 23, 2002, the Council adopted the necessary resolutions to place two measures on the ballot for the November 2002 election, addressing the expenditure limitations in Chapter 1.24 of the Carlsbad Municipal Code (2-1 Hall, absent Kulchin, Finnila). The first measure submits the question to the voters of whether or not the expenditure limitation should be repealed. That particular measure states: "Shall the expenditure limitation set forth in Carlsbad Municipal Code Chapter 1.24 (Prop. H, adopted in 1982), be repealed?" The second measure placed on the ballot was to seek voter approval for spending general funds in an amount over one million dollars for the construction of certain capital facilities. The measure to be voted on at the election will state: "Do the voters of the City of Carlsbad approve spending City funds from various sources including the general fund in an amount over $1 million to construct capital facilities including a swimming pool complex, trails linkages and open space, a Citykafety training facility and a portion of Cannon Road, east of College (Reach 4)?" The action before the Council this evening is to authorize some or all of its members to file written arguments regarding these measures as provided in Section 9382 of the Elections Code. Under that section, the Council or any of its members may file written arguments for or against any City measure up to 300 words in length. The written ballot arguments must include the printed name and signatures of each such member. The City Clerk will set the dates for arguments based on the time reasonably necessary to prepare and print them in the sample ballots and to permit a IO-calendar day public examination, as specified pursuant to Elections Code section 9286. The Clerk intends to establish the following schedule: A. By August 19.2002, arguments are due for or against the measure. B. By August 29, 2002, rebuttals are due. PAGE 2 OF AGENDA BILL NO. 16.850 These steps need to be completed and the documents submitted to the Registrar of Voters by August 30, 2002, in preparation for the public review period commencing on November 2,2002. FISCAL IMPACT: The cost to submit these propositions for the ballot on November 2002 is estimated at $20,000. There are sufficient funds in the City Clerks budget to pay for the costs. If the repeal of the Expenditure Limit (or both measures) is approved by the voters, the City Council will be able to spend more the $1 million in general city funds on any legally allowable project. If only the measure authorizing spending funds on certain capital facilities is approved, then Council will only be able to spend more than $1 million in general city funds on the projects listed in the measure. In both cases, the projects will still be subject to standard City review and approval processes. Council will need to approve the design and construction of the project and appropriate any necessary funds once an estimate of the cost is determined. These measures do not, in and of themselves, authorize the expenditure of any city funds. As of the end of this fiscal year, the available general fund balance will total approximately $73 million. This is 88% of the City’s annual budget for fiscal year 2002-03 (reserve levels are typically measured in terms of percentage of annual budget). It is essential that the City maintain an adequate general fund balance to cover forecasted expenditures and mitigate future risks (e.g., revenue shortfalls and unanticipated expenditures) in order to ensure the financial health of the City. The amount that is necessary is dependent on a number of factors including the health of the economy and the state, predictability of local revenues, the level of expenditures and the amounts deemed necessary to assist in times of a major emergency. Council could spend up to $30 million of the general fund balance on major projects and still have approximately $43 million or 50% of the fiscal year 2002-03 budget available. This should be sufficient to protect against uncertainties in revenues and expenditures as well as provide funds in case of an emergency. ENVIRONMENTAL REVIEW: Neither of these ballot measures authorizes any change to the physical environment at this time. They will allow the City Council to use the general fund to help pay for certain future capital projects as determined by the City Council. Those future capital projects will receive CEQA review when they are funded and approved. EXHIBITS: 1. Resolution No. 2002-230. 2. Resolution No. 2002-233.
