HD. m: DEPT. MAYOR CITYMGR. CITY MANAGER - RECOMMENDED ACTION: Adopt Resolution No. 2002-247 approving Amendment No. 5 to Letter of Understanding with the City Manager. ITEM EXPLANATION: The provisions of the Letter of Understanding of the City Manager were last reviewed in May 2002 and it is recommended that it be amended to adiust the salaw and other supplemental benefits as shown in the attachment to the Resolution. This Amendment No. 5 to the Letter of Understanding would adjust the compensation of the City Manager 5% effective July 1, 2002,6% effective January 1,2003,6% effective July 1,2003,4% effective January 1,2004, 2.5%. effective July 2004, and 6.41% effective January 1, 2005. Thereafter, the City Manager‘s total compensation shall be established at $100 below the second highest paying city in San Diego County based on a market survey of salaries at that time. The Letter of Understanding sets forth the employment relationship between the City Council and the City Manager and supplements his duties as set forth in Chapter 2.12 of the Carlsbad Municipal Code. It provides for annual reviews, annual goal setting defining such goals and performance objectives as may be necessary for the efficient and proper operation of the City and the attainment of the City Council’s policies and objectives. It reconfirms the Council’s continued support and encouragement of continuing development and professionalism of the City organization and its employees. It includes provisions for additional discretionary leave, outside teaching and employment and intellectual property rights. FISCAL IMPACT: The cost of the proposed amendments to the City Manager’s compensation will be approximately $7,275 in calendar year 2002; $19,663 in calendar year 2003; $1 1,797 in calendar year 2004 and $12,207 in calendar year 2005. Thereafter the fiscal impact will depend on the results of the other San Diego County cities included in the survey pursuant to Council policy. The Finance Director is directed to appropriate the necessary funds from the General Fund balance to the City Manager‘s budget to support these costs. ENVIRONMENTAL REVIEW: This amendment is statutorily exempt from CEQA pursuant to Public Resources Code section 21080(b)(l). EXHIBITS: 1. That the above recitation is true and correct. 2. That the Letter of Understanding between the City Council and City Manager dated November 21, 1996 and as previously amended by Amendment No. 1 on August 10,1999, Amendment No. 2 on October 17,2000, Amendment No. 3 on March 13,2001, Amendment No. 4 on May 21,2002 is further amended by Amendment No. 5 attached to this resolution. 3. That the Finance Director is directed to transfer the necessary funds from the General Fund balance to the City Manager’s budget to support the costs of this amendment.
