RECOMMENDED ACTION: Receive presentation from Jeff Seymour, a citizen of Carlsbad ITEM EXPLANATION: The City Council provides an opportunity for citizens and organizations to have an item placed on a City Council Agenda by submitting a letter to the City Manager. Attached is a letter (Exhibit 1) from Jeff Seymour, which requests that the City Council consider amending the City's Zoning Code to allow equestrian uses on property zoned R-3. Teff Sevmour 234 Date Avenue, Carlsbad, CA 92008 (760) 434-7742 July 8, 2002 Mr. Joseph Garuba Management Analyst City of Carlsbad 1200 Carlsbad Village Drive Carlsbad, CA 92008-9461 RE: 234 Date Avenue, Carlsbad, Dear Mr. Garuba: As we have discussed the above referenced property is zoned R-3, and consists of approximately 1 acre of land and is where I am now keeping my horse, Toby. The owners of the property have approved my maintaining a horse on the property, as well as, all of the neighbors adjacent to it, as evidenced by their signing a recent petition. After my discussions with the Mayor and yourself, I would like you to consider this my request to allow my keeping the horse on the property under a Conditional Use Permit. In order to accomplish this it is my understanding that following language should be incorporated into the current city code section 21.16.015: “On each lot or combination of adjacent lots under one ownership, there may be kept one horse for each ten thousand square feet in the lot or lots; provided, however, that any such horse may be kept only if it is fenced and stabled so that at no time is it able to graze, stray or roam closer than fifty feet to any building used for human habitation, other than buildings on the lot or lots, and as to those buildings, no closer than forty feet. ” This is the same language that the City of Carlsbad utilizes in its R-I One Family Residential Zone. Mr. Garuba, due to my obtaining approval and support from the surrounding neighbors and due the substantial size of the property, I request the a Conditional Use Permit be issued on the property located at 234 Date Avenue, Carlsbad, which would allow my keeping a horse on it.
