RECOMMENDED ACTION:
Adopt Resolution No. 2002-253 granting relief to the lowest bidder and rejecting all bids for the construction of the Public Works Center, Project Nos. 3572 and 3688, and Fire Station No. 5 Storage Facility and Skate Park Restrooms, Project No. 3655.

ITEM EXPLANATION:
The proposed Public Works Center would consolidate all Public Works MSA Departments into one location at the existing Safety Center Campus except for the Engineering Development
Avenue yard, the Pi0 Pic0 Drive yard, the Orion Street yard, and all of the Engineering Services Services Division. The consolidation proposed would include staff and equipment from the Oak
staff currently on the second floor of the Faraday Building. This would consolidate the Public Works Department (comprised of Engineering Services Department, General Services Department, and the Maintenance 8, Operations Department) into one modern facility.
The Public Works Center project would include a new 68,000 square foot building for administration and shops, a 17,000 square foot citywide warehouse, replacement ball field, public

The proposed Fire Station No. 5 Storage Facility and the Skate Park Restroom projects included a new storage facility and public restroom at the existing fire station. These projects were bid as part of the larger Public Works Center project in an effort to receive more favorable bid results for this relatively small project.
Council authorized advertisement for bids on January 2, 2002, and received the following bids on March 28, 2002. The base bid includes the Public Works Center, Fire Station No. 5 Storage Facility and Skate Park Restrooms.

The Engineer's Estimate was $13,100,000. The apparent low bidder requested to withdraw its bid due to a material clerical error. Staff, the City Attorney and the Purchasing Officer reviewed the request. All parties agreed that the error resulted in an under-bid of approximately $3,000,000. The remaining three bids significantly exceed the Engineer's Estimate.
The City has recently acquired the Farmers Building and is currently performing a study to evaluate the space, siting and adjacency needs for the City. In order to completely address the City's future requirements, this study would need to consider all departments, including Public Works. The study will help in determining if the proposed Public Works Center helps achieve the ultimate needs for the City. Upon completion of the study, a determination could be made as to whether to proceed with the Public Works Center as designed.

Based on the high construction bids and the City's desire to conduct a com rehensive study to determine future facility needs, staff recommends adoption of Resolution No. 2 002-253 rejecting all bids for Project Nos. 3572. 3688 and 3655. If the bids are rejected, staff will evaluate how to address the Fire Station No. 5 Storage Facility and the Skate Park Restroom projects.
FISCAL IMPACT
The bid rejection process will have minimal fiscal impact. However, to date, CFD #I funds totalin approximately $1 .I million have been spent for the design of the project. This and other factors wi 7 I be reviewed by City staff in the space needs evaluation process.
