TEM EXPLANATION :
2MC Section 3.28.040 (c) (7) requires City Council approval of subsequent amendments to
Irofessional services agreements whose cumulative value exceeds 25% of the original contract
lalue up to $1 00,000. Amendment No. 6 to the design agreement with P & D Consultants for the
lesign of Aviara Community Park approved previously by the City Council on July 24, 2001 will
?xceed this threshold. This Amendment No. 6 was required due to additional design revisions to
,he park layout to enable: (1) access modifications to accommodate larger maintenance vehicles
Mithin the park site; (2) grading modifications to accommodate the addition of synthetic turf to the
soccer field; (3) drainage modifications and realignment of the pathway around the soccer field;
and (4) drainage modifications to the storm drain and water main around the baseball field
ncluding required modifications to the water main easements.
Staff recommends approval of Amendment No. 6 to the existing design agreement.
X3CAL IMPACT:
The total cost of Amendment No. 6 is $27,600. Funds are available within the existing project
account for this Amendment without requiring any additional appropriations.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING
AMENDMENT NO. 6 TO AN EXISTING DESIGN
AGREEMENT FOR AVIARA COMMUNITY PARK, CITY
PROJECT NO, 36991
WHEREAS, the City Council of the City of Carlsbad, California, previously
approved a design agreement with P & D Consultants on July 24, 2001 for the design of
Aviara Community Park; and
WHEREAS, CMC Section 3.28.040, c, 7 requires City Council approval of
subsequent amendments whose cumulative value exceeds 25% of the original contract
total up to $1 00,000 and said Amendment No. 6 exceeds said threshold; and
WHEREAS, the City Council hereby finds, it necessary, desirable, and in the
public interest to approve said Amendment No. 6 to the existing agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad. California, as follows:
1. That the above recitations are true and correct.
2. That Amendment No. 6 to the existing design agreement with P & D Consultants
for Aviara Community Park is hereby approved and the Mayor is authorized to
execute said Amendment. Following the Mayor’s signature of said Amendment
No. 6, the City Clerk is directed to forward copies of the executed Amendment to
the Recreation Department for further processing.

AMENDMENT NO. 6 TO AGREEMENT FOR DESIGN
SERVICES FOR AVIARA COMMUNITY PARK
This Amendment No. 6 is entered into and effective as of the /57& day of
by and between the City of Carlsbad, a municipal corporation, ("City"), and P & D
Consultants, ("Contractor") (collectively, the "Parties") for design services for Aviara
Community Park..
RECITALS
5Et7G It4 bcrr . , 2002, amending the agreement dated July 24. 2001, (the "Agreement")
A. On October 18, 2001, the Parties executed Amendment No. 1 to the above
referenced Agreement; and
B. On March 1, 2002. the Parties executed Amendment No. 2 to the above
referenced Agreement; and
C. On June 3, 2002, the Parties executed Amendment No. 3 to the above referenced
Agreement; and
D. The Parties are currently processing Amendment Nos. 4 and 5 to the above
referenced Agreement; and
E. The Parties desire to alter the Agreement's scope of work to include additional
design services required of the Project; and
F. The Parties have negotiated and agreed to a supplemental scope of work and fee
schedule, which is attached to and incorporated by this reference as Exhibit "A, Scope of
Services and Fee.
NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained
herein, City and Contractor agree as follows:
1. In addition to those services contained in the Agreement, as may have
been amended from time to time, Contractor will provide those services described in Exhibit
"A.
2. City will pay Contractor for all work associated with those services
described in Exhibit "A on a time and materials basis not-to-exceed twenty seven thousand
six hundred dollars ($ 27,600). Contractor will provide City, on a monthly basis, copies of
invoices sufficiently detailed to include hours performed, hourly rates, and related activities
and costs for approval by City.
3. Contractor will complete all work described in Exhibit "A within the
previously established design schedule for the Project.

4. All other provisions of the Agreement, as may have been amended from
time to time, will remain in full force and effect.
5. All requisite insurance policies to be maintained by Contractor pursuant
to the Agreement, as may have been amended from time to time, will include coverage for
this Amendment.
6. The individuals executing this Amendment and the instruments
referenced in it on behalf of Contractor each represent and warrant that they have the legal
power, right and actual authority to bind Contractor to the terms and conditions of this
Amendment.

EXHIBIT ‘‘A’’
C07 - Additional Design Revision Senices
The following are redesigns requested by the City of Carlsbad after Plan Submittals. Because of the
complexity and numerous sets of plans (Public Grading Plans, two sets of Public Improvement Plans, and a
set of Precise Grading Plans), in most cases the design changes need to be incorporated into more than two
different sets of plans. The changes are as follows:
I. In order to accommodate large maintenance vehicles, redesign the paths around the soccer and baseball
fields from 6 feet to IO feet wide. The redesign includes not only the path width, but the grading adjacent
to the paths. Evaluate alternatives for using the warning track of the baseball field for access, to allow the
sidewalk behind the field to remain 6 feet wide. Redesign any storm drain adjacent to the path to
accommodate the widened path.
2. The Conditional Use Permit and grading plans were prepared with a 2% crossfall to allow either natural
field turf or artificial turf. Based on the requirements of the selected manufacturer of the artificial turf,
redesign the grading around the soccer field to accommodate a 1 .O% crossfall for the tournament field and
a 6-inch subgrade section for the entire artificial turf. Prepare additional detail design of a seat wall and
landscape area to function as a vehicle barrier to protect the soccer fields from vandalism by vehicles and
provide a spectator viewing area. Prepare details for an art element to be incorporated in the viewing area.
This task will include a grading redesign for the soccer field and earthwork for the entire project to obtain
a balanced site.
3. Redesign the alignment of the path around the soccer field so that it can be used as a header or limit line
for the artificial turf This realignment of the path horizontally includes redesigning: the storm drain north
and south of the soccer field, the detention basin sonth of the soccer field, and the grading adjacent to the
revised path.
4. Redesign the storm drain and water main adjacent to the baseball field to accommodate the larger playing
field as requested by the City. Redesign both the storm drain and the water main to avoid locating either
in the outtield or under the outfield fence. Recalculate easements to accommodate the revised water main.
