RECOMMENDED ACTION:
Adopt Resolution No. 2002-276 approving three Joint Use Agreements with San Diego
Gas & Electric Company for Rancho Santa Fe Road Realignment and Widening, Phase 1,
Project No. 3190.
ITEM EXPLANATION:
In 1987, City Council made the decision to realign Rancho Santa Fe Road from La Costa Avenue to
Melrose Drive. The new alignment crosses three existing San Diego Gas & Electric Company
(SDG&E) easements. SDG&E desires to have a separate Joint Use Agreement for each of the
facilities have crossed SDG&E easements.

SDG&E is requesting a fee of $36,02Iin administration fees for the Joint Use Agreements and
easements as outlined in the Fiscal Impact section below.
The agreements authorize the City Engineer to execute all appropriate documents to carry out the
intent of this agreement. Documents include a “Letter of Permission for Grading and Construction
Improvements” that will be issued to the City by SDG&E prior to the start of work for both Phase 1
and Phase 2 of the Rancho Santa Fe Road project.

SDG&E is requesting a payment of $36,021. This includes a $0.56 per square foot cost for each
easement that crosses the Rancho Santa Fe Road right-of-way and is based on an appraisal
preformed by SDG&E. The cost per square foot is a percentage of the fair market value of the
SDG&E appraisal. Below is a summary of administrative and easement costs:

The cost for these Joint Use Agreements will be paid from the Construction Contract costs identified
above. The Rancho Santa Fe project account has sufficient funds appropriated for this work.
ENVIRONMENTAL IMPACTS:
The City Council, at its meeting on June 2, 1992, passed Resolution No. 92-152 certifying
EIR No. 91-1 for this project. The City Council at its meeting on April 25, 2000 passed Resolution
No. 2000-128 approving Addendum No. 2 to the Final EIR for Rancho Santa Fe Road Realignment.
This EIR covers the realignment and widening of Rancho Santa Fe Road from La Costa Avenue to
Melrose Drive.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THREE JOINT USE
AGREEMENTS WITH SAN DIEGO GAS & ELECTRIC COMPANY
FOR RANCHO SANTA FE ROAD REALIGNMENT AND
WIDENING, PROJECT NO. 3190.
WHEREAS, the City Council of the City of Carlsbad, California has determined it
lecessaty and in the public interest to approve three separate Joint Use Agreements with
;an Diego Gas' & Electric Company (SDG&E) for the realignment and widening of Rancho Santa
'e Road, which crosses three separate SDG&E existing easements; and
WHEREAS, the City of Carlsbad and SDG&E have jointly agreed on the location of the -,
:ity road crossings for each of the existing SDG&E easements; and
WHEREAS, The City Engineer has determined that the fee of $36,021 requested by
;DG&E for the three easement crossings is reasonable; and
WHEREAS, SDG&E is willing to allow the Rancho' Santa Fe Road crossings of their
!xisting easements in exchange for the payment of the $36,021 fee.
NOW,, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad,
:alifornia, as follows:
1. That the above recitations are true and correct.
2. That the three Joint Use Agreements Between the City Of Carlsbad and San Diego
;as & Electric Company, which are attached hereto and incorporated herein by this reference are
ereby approved and the Mayor is authorized and directed to execute said Agreements.
3. That the Finance Director is authorized and directed to pay to San Diego Gas &
llectric Company the one-time fee in the sum of $36,021. The payment is to be delivered to
:ngineering for forwarding SDG&E.

4. The City Clerk is authorized and directed to forward copies of the signed
lreements to Engineering for forwarding to SDG&E along with the check for $36,021.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
