RECOMMENDED ACTION:
Adopt Resolution No. ~002-297 appropriating funds from Planned Local Drainage Area "A"
Fund for upgrade and replacement of Master Planned Drainage Facility "AC located at the north
end of Highland Drive, Project No. 3905.
ITEM EXPLANATION:
The City's Master Drainage and Storm Water Quality Management Plan (Master Drainage Plan)
adopted by Council in March of 1994 calls for the upgrade and replacement of an existing storm
drainage facility extending from the north terminus of Highland Drive to the Hosp Grove Park
property. The facility to be upgraded and replaced is part of a larger storm drainage project identified
as Facility "AC" in the Master Drainage Plan. In addition to the proposed facility to be upgraded and
replaced, Facility "AC includes the extension of a new storm drain line from the existing line at the
north terminus of Highland Drive southerly to Forest Avenue.
A video survey was conducted in November of 2000 on the existing portion of storm drain Facility
"AC". The video survey identified numerous areas where the pipe was broken and disjointed
allowing drainage water to be discharged into the adjacent soils. Visual inspection of the area
surrounding the pipe indicates a significant amount of erosion has occurred in the immediate vicinity

In February of 2001, Mr. Dunn, the owner of the property located between Highland Drive and the
City's Hosp Grove Park site, across which the existing drain pipe extends, submitted plans to the
City for preliminary review of a proposed single family residence. One of the issues raised in the City
response letter to Mr. Dunn was the matter of resolving the storm drain facility problems. On
November 1, 2001, Mr. Dunn's engineering consultant, Mr. Gary Lipska, submitted a letter
constructing the portion of Facility "AC that extends across his property. requesting City consideration of a reimbursement agreement with Mr. Dunn to pay him for
After conducting an investigation of the matter, the Engineering Department responded by letter to
Mr. Lipska on March 11. 2002 informing him that we would make a recommendation to Council to
fund the project in the Fiscal Year 2002-03 Capital Improvement Program (CIP) budget. We also
stated we would consider entering into a reimbursement agreement with Mr. Dunn to construct the
storm drain concurrent with his single family residence project in an effort to advance its
construction. Due to time and resource constraints, staff was unable to include this project in the
budgetary request for the FY 2002-03 CIP. We are therefore requesting appropriation for this project
by way of this agenda bill.
Subsequent to our letter of March 11, 2002, Mr. Dunn retained an attorney to assist him with the
resolution of this matter.

Staff intends to proceed with the preliminary engineering for the project and obtain the
environmental and permitting approvals for the storm drain project. Once the permits have been
whether to proceed with construction as a City project or as a reimbursement agreement with Mr.

ENVIRONMENTAL REVIEW
The replacement of the storm drain is categorically exempt from CEQA per Section 15301(d) as the
repair of an existing facility. Consultation with the Planning Department and, if necessary, a
biological survey will be performed in conjunction with preliminary design. Final design will not
commence until after environmental approval has been obtained

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROPRIATING FUNDS FROM
PLANNED LOCAL DRAINAGE AREA "A FUND FOR UPGRADE
AND REPLACEMENT OF MASTER PLANNED DRAINAGE
FACILITY "AC LOCATED AT THE NORTH END OF HIGHLAND
DRIVE, PROJECT NO. 3905
WHEREAS, the existing public storm drainage facility extending from the north terminus of
4ighland Drive to the Hosp Grove Park property has been inspected by the City Engineer and
ound to be in need of significant repair; and,
WHEREAS, said storm drain is part of Storm Drain Facility "AC identified in the City's
Aaster Drainage and Storm Water Quality Management Plan ("Master Drainage Plan"); and,
WHEREAS, the Master Drainage Plan recommends that the existing storm drain facility
xated at the north end of Highland Drive be removed and replaced with a larger storm drain pipe
"Storm Drain Project"); and,
WHEREAS, the City has established a Planned Local Drainage Area Fee program for the

2. That funds in the amount of $256,600 are hereby appropriated to the Storm Drain
