ENG TITLE: REVISE THE EXISTING PRIMA FACIE SPEED LIMIT UPON A PORTION OF AVENIDA ENCINAS CITY ATTY. @- CITY MGR. % RECOMMENDED ACTION: Introduce Ordinance No. NS-648 to establish upon Avenida Encinas a prima facie 40 mile per hour speed limit from a point 3,500 feet southerly of Palomar Airport Road to its intersection with Palomar Airport Road. ITEM EXPLANATION: Avenida Encinas is designated as a secondary arterial on the Circulation Element of the General Plan. From a point 3,500 feet south of Palomar Airport Road to the intersection of Palomar Airport Road, the existing prima facie speed limit is 35 miles per hour. The Carlsbad Police Department requested that this speed zone be re-evaluated and be considered to have a higher speed limit posted. The subject portion of Avenida Encinas follows a relatively straight alignment and has been improved with curb and gutter, sidewalk, and street lights on the east side. An asphaltic-concrete berm is constructed on the west side. The road segment varies in width from 31 to 64 feet with on-street parallel parking permitted in some locations. A speed survey conducted in conjunction with updating the Engineering and Traffic Survey found a critical speed (85Ih percentile) of 42 miles per hour, with 90% of the vehicles within the pace speed of 35 to 45 miles per hour. The results of the Engineering and Traffic Survey, including the low collision rate, support raising the prima facie speed limit to 40 miles per hour on Avenida Encinas from a point 3,500 feet southerly of Palomar Airport Road to its intersection with Palomar Airport Road. Sections 22357 and 22358 of the California Vehicle Code authorize local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance, and conditions that may not be readily apparent to the driver. At their meeting on August 5, 2002, the Traffic Safety Commission considered the results of the Engineering and Traffic Survey to revise the prima facie speed limit upon Avenida Encinas from a point 3,500 feet southerly of Palomar Airport Road to its intersection with Palomar Airport Road. The Commission recommended by a 4-0 vote to establish a 40 mile per hour prima facie speed limit upon Avenida Encinas from a point 3,500 feet southerly of Palomar Airport Road to its intersection with Palomar Airport Road. The other previously established prima facie speed limits upon Avenida Encinas from Carlsbad Boulevard to Cannon Road will remain unchanged. The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer. FISCAL IMPACT: Replacing the existing speed limit signs upon Avenida Encinas will cost about $500. EXHIBITS: 1. Location Map. 2. NS-648 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 10.44.280 TO ESTABLISH A PRIMA FACIE 40 MILE PER HOUR SPEED LIMIT UPON AVENIDA ENCINAS FROM A POINT 3,500 FEET SOUTHERLY OF PALOMAR AIRPORT ROAD TO ITS INTERSECTION WITH PALOMAR AIRPORT ROAD. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended ~y the revision of Section 10.44.280 to read as follows: “1 0.44.280 Avenida Encinas: (a) Upon Avenida Encinas from Carlsbad Boulevard to a point three thousand ‘eet northerly of Poinsettia Lane, the prima facie speed limit shall be thirty-five miles per hour. (b) Upon Avenida Encinas from a point three thousand feet northerly of ’oinsettia Lane to a point three thousand five hundred feet southerly of Palomar Airport Road, the xima facie speed limit shall be thirty miles per hour. (c) Upon Avenida Encinas from a point three thousand five hundred feet ;outherly of Palomar Airport Road to its intersection with Palomar Airport Road, the prima facie ;peed limit shall be forty miles per hour.
