RECOMMENDED ACTION:
Introduce Ordinance No. NS-649 to establish upon Chestnut Avenue a prima facie 30 mile per
hour speed limit from El Camino Real to Sierra Morena Avenue.
ITEM EXPLANATION:
The Carlsbad Police Department has requested that a prima facie speed limit be established upon
Chestnut Avenue from El Camino Real to Sierra Morena Avenue. Chestnut Avenue is unclassified
on the Circulation Element of the General Plan and functions as a residential collector.
A prima facie 35 mile per hour speed limit has previously been established upon Chestnut Avenue
from Pi0 Pic0 Drive to El Camino Real.
The subject road segment is a 40 foot wide two-lane road 0.25 miles long with a double-yellow
centerline stripe separating traffic lanes. The road is fully improved with curb and gutter, sidewalks,
and street lights. Parking is permitted on both sides of the road except near El Camino Real on the
north side. Traffic control is provided on Chestnut Avenue by a traffic signal at El Camino Real and
a stop sign at Sierra Morena Avenue. The two-way daily traffic volume between El Camino Real
and Sierra Morena Avenue is 4,400 vehicles over a 24-hour period. There are nine driveways
intersecting Chestnut Avenue between Trieste Drive and Sierra Morena Avenue.
The 85'h percentile speed (critical speed) in the subject road segment is 32 miles per hour.
Sections 22357 and 22358 of the California Vehicle Code authorize local authorities to establish a
prima facie speed limit on the basis of the results of an Engineering and Traffic Survey.
The Engineering and Traffic Survey considers such factors as the number of collisions that have
occurred on the road segment, roadway features, adjacent land uses, driveway locations,
traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight
distance, and conditions that may not be readily apparent to the driver.
At their meeting on July 1, 2002, the Traffic Safety Commission considered the results of the
Engineering and Traffic Survey to establish a prima facie speed limit upon Chestnut Avenue from
El Camino Real to Sierra Morena Avenue. The Commission recommended by a 4-0 vote to
establish a 30 mile per hour prima facie speed limit upon Chestnut Avenue from El Camino Real to
Sierra Morena Drive. The previously established 35 mile per hour prima facie speed limit upon
Chestnut Avenue from Pi0 Pic0 Drive to El Camino Real is unchanged.
The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic
Engineer.
FISCAL IMPACT:
Installing two additional speed limit signs upon Chestnut Avenue will cost about $250.

ORDINANCE NO. NS-649
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44,
OF THE CARLSBAD MUNICIPAL CODE BY THE REVISION OF
SECTION 10.44.040 TO ESTABLISH A PRIMA FACIE 30 MILE PER
HOUR SPEED LIMIT UPON CHESTNUT AVENUE FROM EL CAMINO
REAL TO ITS INTERSECTION WITH SIERRA MORENA AVENUE.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1 : That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
by the revision of Section 10.44.040 to read as follows:
“1 0.44.040 Chestnut Avenue:
(a) Upon Chestnut Avenue from Pi0 Pic0 Drive to its intersection with
El Camino Real, the prima facie speed limit shall be thirty-five miles per hour.
(b) Upon Chestnut Avenue from El Camino Real to its intersection with
Sierra Morena Avenue, the prima facie speed limit shall be thirty miles per hour.”
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and
the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it PG be
published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen
(1 5) days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the
15 th day of OCTOBER ,2002, and thereafter,
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the day of , 2002 by the following vote, to wit:
