RECOMMENDED ACTION:
Adopt Resolution No. 2002-313 authorizing payment to SDG&E for the relocation of electrical facilities related to Poinsettia Lane Reach C, Project No. 3673 and appropriating funds.
ITEM EXPLANATION:
On September 23, 2002 , the City Council approved a Reimbursement Agreement with Redeemer by the Sea Lutheran Church for the grading of Poinsettia Lane Reach C. Near the easterly end of Reach C a pair of SDG&E electrical transmission lines cross the roadway alignment. To provide the proper clearance between the roadway and the transmission lines, one of the poles supporting the wires needs to be relocated.
SDG&E has prepared plans for the work to relocate the pole and they have estimated that the cost of construction will be $38,668. SDG&E will complete the construction upon payment of the estimated cost and at the conclusion of the construction they will either bill or refund any differences between the estimated and actual costs. Staff recommends authorizing payment to SDG&E in an
amount not to exceed $45,000, which provides a 15% contingency.
ENVIRONMENTAL:
The potential impacts of the construction of Poinsettia Lane Reach C have been reviewed consistent with the California Environmental Quality Act as part of the certified Environmental Impact Report for the Zone 20 Specific Plan (EIR 90-03). In addition, the Mitigated Negative Declaration for the De Jong residential project (CT 98-05) was certified on November 30, 1998, and the Negative Declaration for the Redeemer by the Sea project (CT 00-22) was certified on February 12, 2002.
The Planning Director determined that the environmental effects of this project have already been considered in conjunction with the previously mentioned environmental documents and, therefore, no additional environmental review is required. A public Notice of Prior Environmental Compliance was published on January 6, 1999, and a Notice of Determination was filed immediately thereafter.
FISCAL IMPACT:
SDG&E has estimated the cost of the construction will be $38,668 and staff is recommending providing a 15% contingency for a total of $45,000. The cost of the SDG&E construction will be funded by Bridge and Thoroughfare District No. 2 (B&TD #2) fee revenues.
The total cost of the project (of which the SDG&E work is a part) is estimated at $1.8 million. There are not sufficient B&TD #2 funds collected as of this date to pay for the project costs. Council previously approved a loan to B&TD #2 from the General Fund for $500,000 and a loan from the
Gas Tax Fund for $2.5 million. These loans paid for the School District's share of the road improvements ($1.5 million), and provided cash flow so that current obligations for the road improvements could be paid. The current balance of available B&TD #2 funding is approximately $1.3 million dollars.
To fully fund the estimated construction costs of the Poinsettia Lane Reach C project, staff recommends that the current B&TD #2 cash balance as well as a $340,000 loan from the General
Capital Construction fund be appropriated to the Poinsettia Lane Reach C project accounts. This will be added to the existing B&TD #2 appropriations of $215,000 resulting in a total appropriation to the project of $1.8 million. The loans will be repaid as the adjacent land develops and the B&TD #2 fees are collected.

The following table summarizes the estimated construction costs and funding sources for the construction of the Poinsettia Lane Reach C road improvements. For clarity the relocation of the
SDG&E facilities have been broken out as a separate line item.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING PAYMENT TO SDG&E
FOR THE RELOCATION OF ELECTRICAL FACILITIES RELATED TO
POINSETTIA LANE REACH C, PROJECT NO. 3673 AND
APPROPRIATING FUNDS
WHEREAS, the City of Carlsbad proposes to construct Poinsettia Lane Reach C, which
extends the roadway from Black Rail Road to just west of Ambrosia Lane, pursuant to City Project
No. 3673; and
WHEREAS, on September 24, 2002 the City Council approved a Reimbursement
Agreement with Redeemer by the Sea Lutheran Church for the grading of Poinsettia Lane Reach
C; and
WHEREAS, the existing electrical transmission lines need to be relocated to provide
adequate clearance from future vehicular traffic on Poinsettia Lane Reach C; and
WHEREAS, SDG&E agrees to relocate their transmission pole and conductor wires as
needed to provide adequate clearance in consideration of the actual cost of construction which
they have estimated at $38,688; and
WHEREAS, the total construction cost for the entire Poinsettia Lane Reach C project is
estimated at $1.8 million; and
WHEREAS, B&TD #2 funds totaling $21 5,000 are already appropriated.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That a loan from the General Capital Construction fund to the B&TD #2 fund in the
amount of $340,000 is authorized.
3. That the Finance Director is authorized to appropriate an additional $1,607,000
which includes B&TD #2 funds of $1,267,000 plus the loan from the General Capital Construction

4. That the finance director is authorized to pay SDG&E the actual cost of
construction not to exceed $45,000 for the relocation of electrical facilities in conflict with future

SUBJECT: Engineerina Fee Reauest - Poinsettia Lane Reach C Proiect
San Diego Gas & Electric (SDG&E) has completed the estimate to engineer the relocation of
transmission overhead facilities per your request.
ENGINEERING COSTS:
The estimated construction fee is $38,668.00. The total Engineering Fee Estimate and payment
required is $4,640.00. This fee will provide for the engineering design, and support functions
(surveying, right-of-way processing, etc.) necessary to finalize the design and preparation of cost
estimates based on the Project scope.
PROJECT SCOPE:
This Project is is to relocate Transmission Pole # 2519267 on TL13804 and raise the conductor
wires that are in finish grade conflict with the proposed construction and improvements of
Poinsettia Lane.
PROJECT LOCATION
The Project is located east of the intersection of Poinsettia Lane and Black Rail Road in
SDG&E’s Transmission corridor for TL13804, TL23002, and TL23006.

The following Project schedule is based on SDG&E’s receipt of your final grading and
improvement plans, and payment of the Engineering Fee Estimate as set forth in this Engineering
Fee Request. Design work will not start until these items are received by Transmission
Engineering.
