RECOMMENDED ACTION:
Adopt Ordinance No. NS-648 amending Title 10, Chapter 10.44, of the Carlsbad Municipal
Code by the amendment of Section 10.44.280 to establish a Prima Facie 40 mile per hour
speed limit upon Avenida Encinas from a point 3,500 feet southerly of Palomar Airport
Road to its intersection with Palomar Airport Road.
ITEM EXPLANATION:
Ordinance No. NS-648 was introduced and first read at the City Council meeting held on
October 15, 2002. The second reading allows the City Council to adopt the ordinance,
which would then become effective in thirty days. The City Clerk will have the ordinance
published within fifteen days, if adopted.

NS-648 ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44,
OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF
SECTION 10.44.280 TO ESTABLISH A PRIMA FACIE 40 MILE PER
HOUR SPEED LIMIT UPON AVENIDA ENCINAS FROM A POINT
3,500 FEET SOUTHERLY OF PALOMAR AIRPORT ROAD TO ITS
INTERSECTION WITH PALOMAR AIRPORT ROAD.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1: That Title IO, Chapter 10.44, of the Carlsbad Municipal Code is amended
)y the revision of Section 10.44.280 to read as follows:
"1 0.44.280 Avenida Encinas:
(a) Upon Avenida Encinas from Carlsbad Boulevard to a point three thousand
eet northerly of Poinsettia Lane, the prima facie speed limit shall be thirty-five miles per hour.
(b) Upon Avenida Encinas from a point three thousand feet northerly of
'oinseltia Lane to a point three thousand five hundred feet southerly of Palomar Airport Road, the
)rima facie speed limit shall be thirty miles per hour.
(c) Upon Avenida Encinas from a point three thousand five hundred feet
ioutherly of Palomar Airport Road to its intersection with Palomar Airport Road, the prima facie
;peed limit shall be forty miles per hour.
(d) Upon Avenida Encinas from Palomar Airport Road to its intersection with
:annon Road, the prima facie speed limit shall be forty miles per hour."
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and
he City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be
iublished at least once in a newspaper of general circulation in the City of Carlsbad within fifteen

PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
