ITEM EXPLANATION:
Kestrel Drive is unclassified on the Circulation Element of the General Plan and functions as a collector road in the Aviara residential community. It is a two-lane road with traffic lanes separated
by a double-yellow centerline stripe. The road has an existing prima facie speed limit of 30 miles per hour.
Kestrel Drive follows a curvilinear alignment and has been improved with curb and gutter, sidewalk, and street lights on both sides of the road. The road is 0.72 miles in length and has grades ranging from 1 .OO% to 10.8%. Parking is allowed on both sides of the road. Kestrel Drive has an Average
There has been one collision on Kestrel Drive in the past five years.
Daily Traffic (ADT) volume that varies between 900 and 1,300 vehicles, depending upon location.
A speed survey cgnducted in conjunction with updating the Engineering and Traffic Survey found a
critical speed (85 percentile) of 38 miles per hour, with 85% of the vehicles within the pace speed of 31 to 41 miles per hour. The results of the Engineering and Traffic Survey support raising the prima facie speed limit to 35 miles per hour on Kestrel Drive from Batiquitos Drive to its intersection
with Aviara Parkway.
Sections 22357 and 22358 of the California Vehicle Code authorize local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have
occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance, and conditions that may not be readily apparent to the driver.

At their meeting on June 3, 2002, the Traffic Safety Commission considered the results of
Batiquitos Drive to its intersection with Aviara Parkway. The Commission recommended by a 4-0
vote to establish a 35 mile per hour prima facie speed limit upon Kestrel Drive from Batiquitos Drive to its intersection with Aviara Parkway.
The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer.
FISCAL IMPACT
Replacing the existing speed limit signs upon Kestrel Drive will cost about $750.

ORDINANCE NO. NS-652
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
THE CARLSBAD MUNICIPAL CODE BY THE REVISION OF SECTION
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF
10.44.530 TO ESTABLISH UPON KESTREL DRIVE A PRIMA FACIE
35 MILE PER HOUR SPEED LIMIT FROM BATlQUlTOS DRIVE TO ITS
INTERSECTION WITH AVIARA PARKWAY.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1 : That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
by the revision of Section 10.44.530 to read as follows:
“10.44.530 Kestrel Drive: Upon Kestrel Drive from Batiquitos Drive
to its intersection with Aviara Parkway, the prima facie speed limit
shall be thirty-five miles per hour.”
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and
the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be
published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen
(15) days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the
22nd day of OCTOBER ,2002, and thereafter,
