I RECOMMENDED ACTION:
Adopt Ordinance No. NS-652 amending Title 10, Chapter 10.44, of the Carlsbad Municipal
Code by the revision of Section 10.44.530 to establish upon Kestrel Drive a prima facie 35
mile per hour speed limit from Batiquitos Drive to its intersection with Aviara Parkway.
I ITEM EXPLANATION:
Ordinance No. NS-652 was introduced and first read at the City Council meeting held on
October 22, 2002. The second reading allows the City Council to adopt the ordinance,
which would then become effective in thirty days. The City Clerk will have the ordinance
published within fifteen days, if adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF
THE CARLSBAD MUNICIPAL CODE BY THE REVISION OF SECTION
10.44.530 TO ESTABLISH UPON KESTREL DRIVE A PRIMA FACIE
35 MILE PER HOUR SPEED LIMIT FROM BATlQUlTOS DRIVE TO ITS
INTERSECTION WITH AVIARA PARKWAY.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1: That Title IO, Chapter 10.44, of the Carlsbad Municipal Code is amended
by the revision of Section 10.44.530 to read as follows:
“10.44.530 Kestrel Drive: Upon Kestrel Drive from Batiquitos Drive
to its intersection with Aviara Parkway, the prima facie speed limit
shall be thirty-five miles per hour.“
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and
the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be
published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen
(15) days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the
22nd day of OCTOBER ,2002, and thereafter,
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 5th day of NOVEMBER ,2002 by the following vote, to wit:
AYES: Council Members Lewis, Kulchin, Finnila, Nygaard, Hall

APPROVED AS TO FORM AND LEGALITY:
