TITLE:
AWARDING CONTRACT FOR PLAYGROUND
EQUIPMENT UPGRADES AT VARIOUS PARK SITES
AND REJECTING LOWEST BID AS NONRESPONSIVE
CONTRACT NO. PKS02-05
RECOMMENDED ACTION:
Adopt Resolution No. 2002-328 rejecting the apparent lowest bid from Sun Country
Systems as non-responsive, and awarding the contract to Park Specialties to furnish and
install new playground equipment at various park sites, Contract No. PKS02-05.
ITEM EXPLANATION:
The City Council approved contract documents and special provisions, and authorized the
City Clerk to advertise for bids for this project by Resolution No. 2002-105. This contract
includes installing improvements at tot lots at six park sites throughout the City. Playground
equipment that meets all Americans with Disabilities Act (ADA) standards, as well as recent
legislation regarding safety compliance, will be installed at six park sites. In addition, over
8,500 square feet of cushioned rubberized surfacing will be installed to provide access to the
playground equipment at eight park sites. Listed below are the park sites selected for these
improvements. In addition, attached as Exhibit 2 are design copies of the improvements.

The City received five bids that were opened, witnessed and recorded on September 19,
2002. The bids were reviewed by Purchasing and General Services staff, and were as
follows:
1. Sun Country Systems $238,384
2. Park Specialties $261,446
3. Zasueta Contracting $302,668
4. Carson Services Company $304,646
5. CLS Landscape Management $314,225
The City’s specifications for this project require that all play structure equipment is certified
by the International Play Equipment Manufacturers Association (IPEMA) and conforms to the
safety standards of the American Society for Testing and Materials (ASTM). The IPEMA
Certification Seal signifies that a manufacturer’s product conforms to ASTM requirements. Of
the 78 manufactured products submitted by Sun Country Systems for installation, 70
products are not certified by IPEMA, making Sun Country’s bid non-responsive.
The next apparent low bid was submitted by Park Specialties. Staff confirmed that the
manufactured products submitted by Parks Specialties for installation are certified by IPEMA
for conformance with ASTM standards, and its proposal complies in all other aspects with
the City’s specifications for this project.

Staff is recommending that Council reject the bid from Sun Country Systems as non-
responsive, and accept the bid of $261,446 from Park Specialties, and award Park
Specialties Contract No. PK02-05 to furnish and install new playground equipment at various
park sites.
ENVIRONMENTAL REVIEW:
This project has been determined to be exempt from environmental review per CEQA- Class
1 (c), Minor alteration of existing facility.
FISCAL IMPACT
The estimated project cost is $300,000, including contingency funds. Funding is available in
the City’s C.I.P. Program budget and in the Parks Maintenance Capital Outlay and
Maintenance & Operations budgets in the amount of $300,000 to complete this project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS, REJECTING
THE APPARENT LOW BID, AND AUTHORIZING THE
INSTALL NEW PLAYGROUND EQUIPMENT UPGRADES AT
VARIOUS PARK SITES
EXECUTION OF CONTRACT NO. PKS02-05 TO FURNISH AND
WHEREAS, the City Council adopted Resolution No. 2002-105 approving contract
documents, special provisions and specifications, and authorized the City Clerk to advertise
for bids to furnish and install playground equipment upgrades at various park sites,
hereinafter referred to as the “Project;” and
WHEREAS, the bids were received, opened, witnessed and recorded on September 19,
2002; and
WHEREAS, the apparent lowest bidder’s bid, submitted by Sun Country Systems,
Inc. has been determined to be nonresponsive because ninety percent of the playground
equipment products in the bidder’s proposal did not meet bid-specified safety standards;
and
WHEREAS, the second lowest responsible and responsive bid received was submitted by
Park Specialties in the amount of $261,446; and
WHEREAS, the estimated cost of this project is $300,000 including contingency funds; and
WHEREAS, sufficient funds are available in the Capital Improvement Program
budget, Parks Capital Outlay and in the Parks Maintenance and Operations budgets to fund
Contract No. PKS02-05.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad
as follows:
1. That the above recitations are true and correct.
2. That the City Council does hereby reject the apparent low bid submitted by Sun
Country Systems, Inc. as nonresponsive.

3. The bid of $261,446 by Park Specialties to furnish and install playground
equipment upgrades at various park sites, and a contingency account of $38,554 is hereby
accepted.
4. That the Mayor of the City of Carlsbad is hereby authorized and directed to
execute Contract No. PKS02-05 with Park Specialties.
5. That the award of this contract is contingent upon Park Specialties executing the
required contract and submitting the required bonds and insurance policies, as described in
the contract, within twenty (20) days of adoption of this resolution. The City Manager may
grant reasonable extensions of time.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 12th day of NOVEMBER , 2002, by the following vote,
to wit:
