FOR THE CONSTRUCTION OF SOUTH AGUA HEDIONDA
RECOMMENDED ACTION:
Adopt Resolution No. 2002-329 accepting bids and awarding the contract for the
construction of the South Agua Hedionda Interceptor (SAHI) Phase II Reach 111, Project No. 3583-2.
ITEM EXPLANATION:
The South Agua Hedionda Interceptor (SAHI) system provides sewerage facilities for a portion of the City that currently drains out of basin into the BuenaNallecitos Sewer Basin or the North Agua
SAHI to accommodate the increased flow. Reach 111 constructs the pipeline in Cannon Road Hedionda Sewer Basin. Development in the eastern portion of the City necessitates completion of
between the existing facilities located on each end. The SAHI system will drain into the Vista-Carlsbad Interceptor.
The project includes the extension of a sewer force main from its existing terminus at
constructed from just east of LEGOLAND Drive to Car Country Drive in Cannon Road.

The construction activities include closing westbound Cannon Road from Faraday Avenue to
Car Country Drive. The contract stipulates that the contractor must reopen westbound Cannon Road
thirty-three working days after the City issues the contractor a Notice to Proceed for that phase of
construction. City staff has coordinated the road closure with local businesses and has provided
maps for the businesses to give to their patrons providing alternate routes during the road closure.
On August 13, 2002, the City Council authorized the advertisement for bids for construction of the
proposed improvements. City Council requested that staff add an Incentive to encourage the
Contractor to complete the project earlier than the working days stated in the contract.
Three incentives have been added to the Contract as allowed by Government Code 53069.85.
The first incentive is for executing the contract within 10 calendars days of award by City Council.
The second incentive is for opening Cannon Road between LEGOLAND Drive and Car Country
Drive up to ten calendar days early. The third incentive is for opening the remainder of
Cannon Road up to ten calendar days early. The Engineer's Estimate for the construction of the
project was $1,083,000. Twelve (12) bids were received on October 10, 2002, which are
summarized on Table 1.

With a bid of $648,979, J. Fletcher Creamer and Son, is the lowest responsible and responsive
bidder. All bid documents provided by J. Fletcher Creamer and Son are in order. Therefore,
staff recommends award of the contract to J. Fletcher Creamer and Son.
FISCAL IMPACT
The total estimated construction costs for the project are summarized in Table 2.

ENVIRONMENTAL IMPACTS:
This project is categorically exempt from the environmental review process under Section 15301
Class 1 (C) of the Public Resources Code (California Environmental Quality Act). The Planning
Department has filed a Notice of Exemption. The California Coastal Commission approved the
Coastal Development Permit 6-02-070 on August 7, 2002.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
THE CONTRACT FOR THE CONSTRUCTION OF THE SOUTH
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
AGUA HEDIONDA INTERCEPTOR (SAHI) PHASE II REACH 111,
PROJECT NO. 3583-2.
WHEREAS, plans and specifications have been approved by the City Council of
le City of Carlsbad for the construction of the South Agua Hedionda Interceptor (SAHI) Phase II

WHEREAS, the lowest responsible bid of $648,979 received to construct said project,
ubmitted by J. Fletcher Creamer and Son, is responsive; and
WHEREAS, the total estimated costs for construction of the project is $904,479 as shown

WHEREAS, contractor is eligible for incentive awards consistent with the project terms up

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad,

I. That the above recitations are true and correct.
2. That the bid of $648,979 by J. Fletcher Creamer and Son, for the South Agua
iedionda Interceptor (SAHI) Phase II Reach Ill, Project No. 3583-2, is accepted and the Mayor is
lereby authorized to execute a contract therefore.
3. That the City Manager is hereby authorized to approve construction change orders
~p to $65,000 for Project No. 3583-2.
4. That the City Manager is hereby authorized to approve payment of incentive
\wards to the contractor up to $80,000 consistent with the contract terms for Project No. 3583-2;

5. That the award of this contract is contingent upon J. Fletcher Creamer and Son.,
?xecuting the required contract and submitting the required bonds and insurance policies,
is described in the contract, within twenty (20) calendar days of adoption of this resolution.
The City Manager may grant reasonable extensions of time.
