ATTY. 2!FN RECOMMENDED ACTION: That the City Council ADOPT Resolution of Intention No. 2002-348 , to initiate an amendment to the Rancho Carrillo Master Plan to preserve Village T as a community facilities site. ITEM EXPLANATION: On August 7, 2002, the Planning Commission denied Planning Commission Determination 01-05 allowing Rancho Carrillo Village T to revert from a community service site back to its underlying designation of Residential-Medium. The Planning Commission’s denial was based upon the finding that the applicant did not make a good faith effort to market the site to a community facility type use. The Planning Commission, at its August 7, 2002 meeting, made a minute motion requesting that the City Council initiate an amendment to the Rancho Carrillo Master Plan preserving Village T as a Community facility site. The Rancho Carrillo Master Plan and Municipal Code both contain provisions for the City Council to initiate amendments to the master plan. These Municipal Code and master plan provisions are specifically for the review of the master plan’s fulfillment of current city policies and standards. Since the adoption of the master plan, the City has adopted a Community Facilities Zone which established development standards for community facilities uses in master plans. The proposed master plan amendment will result in the preservation of Village T as a community facilities site. ENVIRONMENTAL REVIEW: The Master Plan Environmental Impact Report included review for either type use for the property. Subsequent environmental review of the development of the site would be completed during project review. FISCAL IMPACT: A change in land use on this site from Community Facility to Residential may have a minor fiscal impact; however, it is not expected to be significant. EXHIBITS: 1. Be it resolved by the City Council of the City of Carlsbad, California, that: pursuant to the Rancho Carrillo Master Plan Chapter 3(F) and Section 21.38.120 of the Carlsbad Municipal Code, the City Council of the City of Carlsbad hereby declares its intention to consider an amendment to the Rancho Carrillo Master Plan (MP 139(H)) to preserve Village T of the master plan as a community facilities site. The Planning Director is directed to prepare said master plan amendment and set the matter for public hearing before the Planning Commission and this City Council.
