ED TITLE: AUTHORIZATION AND APPROPRIATION OF FUNDING LANE FOR THE PURCHASE OF APN 156-164-36 STRATFORD RECOMMENDED ACTION: Approve Resolution No. 2003-032 authorizing the Mayor to execute all documents associated with the purchase of APN 156-164-36 Stratford Lane, Carlsbad, CA from Renate Pietsch, Heidi Pyle, and Edward Zorn, and appropriating $245,000 from the City Council’s Contingency Account for the purchase of said property and payment of surveys, reports and associated fees. ITEM EXPLANATION: In October 2002, the City of Carlsbad was contacted by Mr. Edward Zorn, on behalf of himself and the other owners of the property, and offered an opportunity to purchase the vacant parcel (APN 156- 164-36) located on the south side of Stratford Lane. The parcel is adjacent to the Community Garden, the City’s Arts Office and near City Hall, the Cole Library and other City owned property. On October 14, 2002 the City Council authorized staff to begin negotiations for the purchase of the property in anticipation of a future public use. In November 2002 the City and the property owners, represented by Mr. Zorn, reached an agreed upon purchase price of $235,000, with the closing of escrow proceedings to be contingent upon completion of a a Phase I Environmental Survey to determine the existing condition of the property, and a finding of consistency with the City’s General Plan, to be made by the Carlsbad Planning Commission. ENVIRONMENTAL IMPACT: The Planning Director has determined that the project is exempt from the California Environmental Quality Act, pursuant to Section 15061(b)(3) of the CEQA Guidelines. Section 15061(b)(3) exempts projects or activities where it can be seen with certainty that there is not possibility that the activity may have a significant effect on the environment. Simple acquisition of property, with no plan for development of that property, is such an activity. Should the City decide to pursue development of the site, additional environmental review will be conducted. FISCAL IMPACT: Although the purchase price for the property is $235,000, there will be additional expenses related to closing costs, fees and special studies and reports. Staff is requesting an allocation of $245,000 fi-om the City Council’s Contingency Account to purchase APN 156-164-36 Stratford Lane and pay all associated fees, reports, surveys and other expenses. The Council’s current balance in the Contingency account stands at $2.3 million. Acquisition of this parcel will provide the City with additional property for future public use. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. That the above recitations are true and correct. 2. That the Mayor is authorized to execute all documents associated with the purchase and transfer of interest in APN 156-1 64-36 Stratford Lane to the City of Carlsbad. 3. That an appropriation of $245,000 for purchase of the property, including all associated fees and expenses is authorized from the City Council’s Contingency Account Fund balance. Catisbad. Dear Mrs. Haas: Enclosed please find the CAR form for the Purchase Agreement and Joint Escrow Instructions for the City of Carlsbad purchase of Lot #36 on Stratford. The Forms language requires the presentation of the agreement as an offer to purchase. I have completed the form and ask the authorized representative of the City sign and return the original to me. I will then have all SELLERS sign the agreement and forward it on to open escrow. This shall confirm that the purchase price shall be $235,000.00. You have requested a Sixty day escrow with Continental Escrow Co. Please note that the Quit-Claim Deed provided to you previously has been sent to the San Diego Recorders Office.
