17,064 TITLE: AWARD OF CONTRACT AND APPROPRIATION OF FUNDS FOR CONSTRUCTION OF PALOMAR AIRPORT ROAD AND LA COSTA AVENUE DRAINAGE IMPROVEMENTS, PROJECT NO. 3865

RECOMMENDED ACTION:
Adopt Resolution No. 2003-036 awarding the construction contract and appropriating funds for Palomar Airport Road and La Costa Avenue Drainage Improvements, Project No. 3865.
ITEM EXPLANATION:
The project includes the repair of the City’s storm drain system at two locations. The first location is on Palomar Airport Road, just west of El Camino Real, and the second location is on La Costa Avenue approximately 3/4-mile east of El Camino Real.
On October 1, 2002, the City Council authorized the advertisement for bids for the construction of this project. The Engineer’s estimate for construction was $173,194. On December 5, 2002, three sealed bids were received as follows:
J. Fletcher Creamer & Son, Inc. $208,925
Zondiros Corporation $222,470 Don Hubbard Contracting $239,370
Due to higher than expected costs for trench resurfacing and concrete storm drain, the lowest bid
exceeded the Engineer’s estimate. Re-bidding is not likely to lower the bid prices, therefore, staff recommends the appropriation of additional funds and award of the contract to the low bidder, J. Fletcher Creamer & Son, Inc.
ENVIRONMENTAL REVIEW:
This project is categorically exempt from the environmental review process under Section 15301 Class 1 (c) of the Public Resources Code (California Environmental Quality Act).
FISCAL IMPACT:
The estimated cost to complete this project is:
The original appropriation for this project came from the Infrastructure Replacement Fund. Sufficient funds are not currently available in the project account for construction of these improvements; therefore, staff recommends the appropriation of additional funds from the Infrastructure Replacement Fund in the amount of $37,400 in order to complete this project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AWARDING THE CONTRACT AND
APPROPRIATING FUNDS FOR THE CONSTRUCTION OF
PALOMAR AIRPORT ROAD AND LA COSTA AVENUE DRAINAGE
IMPROVEMENTS, PROJECT NO 3865.
WHEREAS, the City Council of the City of Carlsbad, California, has previously authorized
the advertisement for bids for the construction of Palomar Airport Road and La Costa Avenue
Drainage Improvements, Project No. 3865; and
WHEREAS, three sealed bids were received on December 5, 2002 by the City of Carlsbad
for the construction of Palomar Airport Road and La Costa Avenue Drainage Improvements,
Project No. 3865; and
WHEREAS, all bid documents received from all bidders have been reviewed in detail and
the City Council does hereby find that the lowest responsible and responsive bidder, J. Fletcher
Creamer & Son, Inc., did submit a bid in the amount of $208,925; and
WHEREAS, the original appropriation for this project came from the Infrastructure
Replacement Fund; and
WHEREAS, additional funds in the amount of $37,400 need to be appropriated in order to
construct the drainage repairs at Palomar Airport Road and La Costa Avenue Drainage
Improvements, Project No. 3865; and
WHEREAS, Subsection 3.28.172(~)(1) of the Carlsbad Municipal Code authorizes the City
Manager to approve change orders in the amount equal to the contingency set at the time of the
bid award.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the bid of $208,925 submitted by J. Fletcher Creamer & Son, Inc. for
sonstruction of Palomar Airport Road and La Costa Avenue Drainage Improvements, Project No.
3865, is accepted and the Mayor is hereby authorized and directed to execute a contract therefor.
3. That the Finance Director is hereby authorized to appropriate $37,400 from the
Infrastructure Replacement Fund for completion of this project.

4. That the City Manager is authorized to approve change orders in the amount of
$31,339.
5. That the award of this contract is contingent upon J. Fletcher Creamer & Son, Inc.
executing the required contract and submitting the required bonds and insurance policies as
described in the contract within twenty (20) days of adoption of this resolution. The City Manager
may grant reasonable extension of time.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 4th day of FEBRUARY , 2003 by the following vote, to wit:
