CLK CODE TO ESTABLISH A PRIMA FACIE 35 MILE AMENDtNG THE CARLSBAD MUNICIPAL PER HOUR SPEED LIMIT ON A PORTION OF CASSIA ROAD X’ CITY ATTY. CITY MGR RECOMMENDED ACTION: Adopt Ordinance No. NS-656 amending title 10, Chapter 10.44, of the Carlsbad Municipal Code by the addition of Section 10.44.700 to establish, upon Cassia Road, a Prima Facie 35 mile per hour speed limit from Poinsettia Lane to its intersection with El Camino Real. ITEM EXPLANATION: Ordinance No. NS-656 was introduced and first read at the City Council meeting held on February 4, 2003. The second reading allows the City Council to adopt the ordinance, which would then become effective in thirty days. The City Clerk will have the ordinance published within fifteen days, if adopted. FISCAL IMPACT: See Agenda Bill No. 17,068 on file with the City Clerk. EXHIBITS: 1. NS-656 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE IO, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION 10.44.700 TO ESTABLISH UPON CASSIA ROAD A PRIMA TO ITS INTERSECTION WITH EL CAMINO REAL. FACIE 35 MILE PER HOUR SPEED LIMIT FROM POINSETTIA LANE The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title IO, Chapter 10.44, of the Carlsbad Municipal Code is amended 11 by the addition of Section 10.44.700 to read as follows: "10.44.700 Cassia Road. Upon Cassia Road from Poinsettia Lane to its intersection with El Camino Real, the prima facie speed limit shall be thirty-five miles per hour." EFFECTIVE DATE: This ordinance shall be effective thitty (30) days after its adoption and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the 4th day of FEBRUARY , 2003, and thereafter, PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the llth day of Februarv , 2003 by the following vote, to wit: AYES: Counqil Members Lewis, Finnila, Kulchin, Hall and Packard.
