TITLE: AWARD OF CONTRACT FOR
CONSTRUCTION OF THE
2002103 STREET SEALING PROJECT
PROJECT NO. 3667-6 CITY MGI3.a
RECOMMENDED ACTION:
Adopt Resolution No. 2003-062 accepting bids and awarding the contract to American Asphalt
South, Inc., for the construction of the 2002103 Street Sealing Project, Project No. 3667-6.
ITEM EXPLANATION:
The 2002/03 Street Sealing Project is part of the City's ongoing Pavement Management Program.
This maintenance project will extend the life of various roadways throughout the City by applying a rubberized slurry seal to the roadway surface. The roadways to be sealed were selected based on
the age and existing condition of the roadway surface. The application of rubberized slurry seal
rejuvenates and protects the roadway surface from the harmful effects of sunlight while, at the same
time, protecting the underlying base material from the damaging effects of water penetration.
In addition to the application of the rubberized slurry seal, the project includes sidewalk repairs.
The sidewalk repairs will occur adjacent to the roads receiving the slurry seal application throughout
the project area. By completing these two items of work at the same time, the public right-of-way will be improved by a single construction project which will reduce the construction impacts on the
adjacent residents.
The engineer's construction cost estimate for this project was $490,000. On January 29, 2003, two sealed bids were received for the construction of this project as shown on the following table.

With a bid of $378,985.25, American Asphalt is the lowest responsive and responsible bidder.
All bid documents submitted by American Asphalt have been reviewed by staff and found to be in
order.
ENVIRONMENTAL COMPLIANCE:
This project is categorically exempt from the environmental review process under Section 15301
Class 1 (C) of the California Environmental Quality Act.
FISCAL IMPACT:
The estimated construction costs associated with this project are summarized in the following table.

There are sufficient funds in the Pavement Management Program and the Street Maintenance
Cement Repair accounts to complete the construction. The Pavement Management Program is
funded by TransNet Local, Gas Tax, and State AB 2928 appropriations. The remaining Pavement
Management Program appropriations will fund additional overlay projects that are currently being
designed.

RESOLUTION NO. 2003-062
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A
CONTRACT FOR THE CONSTRUCTION OF THE 2002/03
STREET SEALING PROJECT, PROJECT NO. 3667-6.
WHEREAS, on December 3,2002, the City Council of the City of Carlsbad approved plans
for the construction of the 2002103 Street Sealing Project, Project No. 3667-6; and
WHEREAS, two (2) sealed bids were received on January 29, 2003, by the City of
Carlsbad for the construction of said project; and
WHEREAS, the lowest responsive and responsible bid to construct said project was
submitted by American Asphalt South, Inc., in the amount of $378,985.25; and
WHEREAS, there are sufficient funds available to complete the project; and
WHEREAS, subsection 3.28.172(~)(1) of the Carlsbad Municipal Code authorizes the
City Manager to approve change orders in the amount equal to the contingency set at the time of
bid opening.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the low bid of $378,985.25 submitted by American Asphalt South, Inc., for the
construction of the 2002103 Street Sealing Project, Project No. 3667-6, is accepted and the Mayor
is hereby authorized to execute a contract with American Asphalt South, Inc., for Project No.
3667-6.
3. That the City Manager is hereby authorized to approve construction change orders
up to $56,848.

4. That the award of this contract is contingent upon the bidder submitting the lowest
responsible bid executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within twenty (20) days of adoption of this resolution.
The City Manager may grant reasonable extensions of time.
