TITLE: AWARD OF CONTRACT FOR CONSTRUCTION OF
RECYCLED WATER TRANSMISSION MAINS
POINSETTIA LANE REACH “C” AND DOMESTIC AND
PROJECT NOS. 3673,3585, AND 3675 DEPT. ENG
RECOMMENDED ACTION:
City Council of the City of Carlsbad Adopt Resolution No. 2003-084 awarding the construction
contract for the construction of Poinsettia Lane Reach “C” and Domestic and Recycled Water
Transmission Mains, Project Nos. 3673, 3585, 3675.
Board of Directors of Carlsbad Municipal Water District (CMWD) Adopt Resolution No. 1178
awarding the construction contract for the construction of Poinsettia Lane Reach “C” and Domestic
and Recycled Water Transmission Mains, Project Nos. 3673, 3585, 3675.
ITEM EXPLANATION:
The project includes the extension of Poinsettia Lane between Black Rail Road and Ambrosia Lane, and the installation of domestic water transmission mains, recycled water transmission mains, collector sewer, and storm drain facilities. Poinsettia Lane is a major arterial roadway in the City’s Circulation Element and the 1,400-foot extension is part of Bridge and Thoroughfare District No. 2. The improvements include a four-lane roadway with landscaped median, bike lanes, and streetlights.
Currently, rough grading of the roadway is underway through a reimbursement agreement with Redeemer by the Sea Lutheran Church, which the City Council approved on September 24, 2002.
On August 6, 2002, the City Council authorized the advertisement for bids for the construction of this project. The Engineer’s estimate for construction was $1,936,791. On January 27, 2003, three sealed bids were received as follows:

The lowest bidder, Majich Brothers, was non-responsive because it failed to submit subcontractor
information with its bid as required by the City’s bid documents and Section 4104 of the California
Public Contracts Code. As a result, the lowest responsible and responsive bidder was Orion
Construction. -
ENVIRONMENTAL REVIEW:
The potential impacts of the construction of this portion of Poinsettia Lane have been reviewed
consistent with the California Environmental Quality Act which resulted in the certification in the
Environmental Impact Report for the Zone 20 Specific Plan (EIR 90-03). In addition, the Mitigated
Negative Declaration for the De Jong residential project (CT 98-05) issued on November 30, 1998,
supported the findings of EIR 90-03.
The Planning Director determined that the environmental effects of this project have already been
considered in conjunction with the previously mentioned environmental documents and, therefore,
no additional environmental review is required. A public Notice of Prior Environmental Compliance
was published on January 6, 1999, and a Notice of Determination was filed immediately thereafter.
The Coastal Development Permit 98-26 was approved by Planning Commission Resolution
No. 4508.

FISCAL IMPACT:
The roadway improvements included in this contract are funded with B&TD #2 fee revenues and
loans from the General Capital Construction and Gas Tax Funds. These loans will be repaid as
adjacent land develops and the B&TD #2 fees are collected. The frontage improvements associated
with this contract are funded with developer deposits in the amount of $344,500. Reimbursement
agreements with the Developers were approved by Council on March 11, 2003.
The domestic water mains are funded by Water Connection Fees (CIP #35851). The recycled water
mains are funded by the Encina Basin Water Reclamation Program, Phase II Project (CIP #38871).
Bid items totaling $126,372 for sewer and storm drain are being deleted from this contract
because those items have already been constructed through a reimbursement agreement with
Redeemer by the Sea development.
The excess appropriations in the Domestic Water Mains account (#35851) will be used to construct a
30-inch transmission main in Cassia Road from El Camino Real to Reach 2. The excess appropriations in the Recycled Water Mains account (#38871) will be used to construct recycled water transmission mains throughout the City as part of the Encina Basin Water Reclamation Program,
Phase II Project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AWARDING THE CONTRACT FOR
THE CONSTRUCTION OF POINSETTIA LANE REACH “C” AND
DOMESTIC AND RECYCLED WATER TRANSMISSION MAINS,
PROJECT NOS. 3673,3585. AND 3675,
WHEREAS, the City Council of the City of Carlsbad, California, has previously authorized
the advertisement for bids for the construction of Poinsettia Lane Reach “C” and Domestic and
Recycled Water Transmission Mains, Project Nos. 3673, 3585, and 3675; and
WHEREAS, three sealed bids were received on January 27, 2003 by the City of Carlsbad
for the construction of Poinsettia Lane Reach “C” and Domestic and Recycled Water
Transmission Mains, Project Nos. 3673, 3585, and 3675; and
WHEREAS, all bid documents received from all bidders have been reviewed in detail and
the City Council does hereby find that Majich Brothers’ bid was non-responsive because it did not
include subcontractor information as required by California Public Contracts Code; therefore, the
bid from Majich Brothers is rejected; and
WHEREAS, the City Council does hereby find that the lowest responsible and responsive
bidder, Orion Construction, did submit a bid in the amount of $2,179,559; and
WHEREAS, Subsection 3.28.172(~)(1) of the Carlsbad Municipal Code authorizes the
City Manager to approve change orders in the amount equal to the contingency set at the time of
the bid award.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
I. That the above recitations are true and correct.
. 2. That the bid of $2,179,559 submitted by Orion Construction for construction of
Poinsettia Lane Reach “C” and Domestic and Recycled Water Transmission Mains, Project Nos.
3673, 3585, and 3675, is accepted and the Mayor is hereby authorized and directed to execute a
contract therefor.
3. That the City Manager is authorized to approve change orders up to $201,412.

4. That the award of this contract is contingent upon Orion Construction executing the
required contract and submitting the required bonds and insurance policies as described in the
contract within twenty (20) days of adoption of this resolution. The City Manager may grant
reasonable extension of time.

CARLSBAD MUNICIPAL WATER DISTRICT (CMWD) AWARDING
THE CONTRACT FOR THE CONSTRUCTION OF POINSETTIA
LANE REACH “C” AND DOMESTIC AND RECYCLED WATER
TRANSMISSION MAINS, PROJECT NOS. 3673,3585, AND 3675.
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District (CMWD),
