ENG CITY OF CARLSBAD - AGENDA BILL TITLE: ACCEPTANCE OF THE CANNON ROAD AND EL CAMINO REIMBURSEMENT PROJECT NO. 3184) KELLY RANCH VILLAGE E, CANNON ROAD, REACH 2, PHASE I, STA. 98+35 TO 124+30 REAL PORTION OF PROJECT NO. CT 96-07 (CIP CITY ATTY. CITY MGR. RECOMMENDED ACTION: Adopt Resolution No. 2o03-132 accepting the construction of the Cannon Road and El Camino Real portions of Kelly Ranch Village E, Cannon Road, Reach 2 Phase I, Sta. 98+35 to 124+30, Project No. CT 96-07, CIP Reimbursement Project No. 31 84 as complete, and directing the City Manager to execute the Acceptance of Public Improvements on Cannon Road and El Camino Real. ITEM EXPLANATION: The Carlsbad City Council adopted the Circulation Element of the General Plan as a way to ensure a comprehensive manner and method for the circulation of people, goods, energy, water, sewage, storm waters, communications and services. On February 27, 2001, City of Carlsbad Council Policy Statement No. 63 was issued to establish a policy on the acceptance or conditional acceptance of Circulation Element roadways or portions of such roadways into the City street system. This policy states that City Council shall consider the policies of the General Plan, the standards of the Growth Management Plan, the safety and needs of the traveling public, which in the opinion of the City Council are necessary and appropriate for the orderly, safe and efficient development of the circulation system. Policy No. 63 requires formal City Council acceptance of these Circulation Element roadways into the City’s street system. Cannon Road and El Camino Real meet the criteria of a Circulation Element roadway. On January 16, 2003, Shea Homes completed the work on Cannon Road and El Camino Real from Sta. 98+35 to 124+30 as listed in Improvement Agreement No. SA728.00, Drawing Number 333-26. The work performed by Shea Homes consisted of the construction of Cannon Road between El Camino Real and Frost Avenue. City staff has inspected the work on Cannon Road and El Camino Real and found it to be satisfactory. FISCAL IMPACT: Acceptance of the road has no financial impact. After acceptance, the maintenance of the road will be performed by existing City maintenance crews. EXHIBITS: 1. Location Map. 2. STA. 98+35 TO 124+30, PROJECT NO. CT 96-07, CIP WHEREAS, the construction of CT 96-07, Kelly Ranch Village E, Cannon Road, Reach 2, 'base 1, Sta. 98+35 to 124+30, Cannon Road and El Camino Real has been completed to the Xy’s satisfaction by Shea Homes; and WHEREAS, Cannon Road and El Camino Real meet the criteria of a circulation element Padway as defined in the City’s General Plan and Council Policy No. 63. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, =alifornia, as follows: 1. That the above recitations are true and correct. 2. That the construction of the public improvements on Cannon Road and El Camino qeal, from El Camino Real to Frost Avenue, Sta. 98+35 to 124+30, specifically identified on hawing number 333-2G is deemed complete and is hereby accepted. 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to execute the qcceptance of Public Improvements on Cannon Road and El Camino Real, from El Camino Real o Frost Avenue, Sta. 98+35 to 124+30.
