RECOMMENDED ACTION:
Receive the report on campaign disclosure requirements and direct the City Attorney if
further action is required.
ITEM EXPLANATION:
At its meeting of May 6, 2003, the City Council received a request from James Gaiser, a
citizen of Carlsbad, requesting that the City Council amend the campaign disclosure
requirements. Specifically, he requested that the requirement of copies of checks and an
additional reporting period for campaign disclosures be repealed and that the contribution
limit be increased from $25 to $100.
The Council received this presentation and after its discussions directed the City Attorney to
return with a report on the requirements of other local jurisdictions.
Below, the campaign disclosure ordinances of other San Diego cities are summarized.
The City of Agoura Hills has the lowest minimum contribution for campaign disclosure which
is set at $5.
Cities are empowered to increase the protections of the Political Reform Act of 1974 which
was adopted by the citizens of the State of California at the primary election of June 4, 1974
by virtue of Government Code section 81013. Under that provision, a local agency may
impose additional requirements on any candidate or contributor if the requirements do not
prevent that person from complying with the Act.
If the Council wishes to amend the ordinance, it should direct the City Attorney to prepare the
necessary documents and to return at a regular Council meeting for introduction of the
appropriate ordinance.

ENVIRONMENTAL REVIEW:
The proposed revisions do not constitute a "project" within the meaning of the California
Environmental Quality Act and, therefore, do not require environmental review.
