Adopt Resolution No. 2003-190accepting the construction of Poinsettia Lane Overhead
Widening Project, Project Nos. 3551, 3442, 3829 and 381 0, as complete, and directing
the City Clerk to record a Notice of Completion and release bonds in accordance with
State Law and City Ordinances.

On July 24, 2001, Herzog Contracting Corporation was awarded a contract in the
amount of $1,627,374 for the Poinsettia Lane Overhead Widening project, Project Nos.
3551,3442,3829, and 3810.
Herzog Contracting Corporation completed the street improvement work on December
31, 2002. City staff has inspected the work and found it to be satisfactory. Staff
recommends formal acceptance of the improvements by the City Council.

RESOLUTION NO. 2003-190
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING CONSTRUCTION OF
THE POINSETTIA LANE OVERHEAD WIDENING PROJECT,
PROJECT NOS. 3551,3442,3829, AND 381 0.
WHEREAS, the construction of the Poinsettia Lane Overhead Widening has been
completed to the City's satisfaction by Herzog Contracting Corporation on December 31,
2002; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Poinsettia Lane Overhead Widening, specifically identified as Project
Nos. 3551, 3442,3829, and 381 0, is deemed complete and is hereby accepted.
3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
execute and record the Notice of Completion for Project Nos. 3551, 3442, 3829, and 381 0.
4. That the City Clerk is directed to release all bonds on Project Nos. 3551, 3442,
3829, and 381 0 in accordance with State Law and City Ordinances.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 15th day of JULY , 2003 by the following vote, to wit:
