REPORT AND DISCUSSION OF CAMPAIGN DISCLOSURE REQUIREMENTS CITY ATTY. CITY MGR. Receive the report on campaign disclosure requirements and direct the City Attorney if further action is required. ITEM EXPLANATION: At its meeting of May 6, 2003, the City Council received a request from James Gaiser, a citizen of Carlsbad, requesting that the City Council amend its campaign disclosure requirements. Specifically, Mr. Gaiser requested that the requirement of copies of checks and the additional reporting period for campaign disclosures be repealed and that the disclosure contribution limit be increased from $25 to $100. At its meeting of June 24, 2003, the matter was continued to verify the figures in the survey of other jurisdictions in the County of San Diego. The attached Exhibit 1 entitled “Summary of Local Campaign Finance Ordinance Provisions’’ summarizes the contribution limit, contribution amount, additional campaign statements and copies of checks for 11 cities within San Diego County and for the County itself. This information has been obtained from an analysis of each appropriate ordinance. Cities are empowered to increase the protections of the Political Reform Act of I974 which was adopted by the citizens of the State of California at the primary election of June 4, 1974 by virtue of Government Code section 81013. Under that provision, a local agency may impose additional requirements on any candidate or contributor if the requirements do not prevent that person from complying with the Act. None of Carlsbad’s existing requirements prevent anyone from complying with the Act. If the Council wishes to amend the ordinance, it should direct the City Attorney to prepare the necessary documents and to return at a regular Council meeting for introduction of the appropriate ordinance. FISCAL IMPACT: None at this time. ENVIRONMENTAL REVIEW: The recommended action does not constitute a “project” within the meaning of the California Environmental Quality Act and, therefore, does not require environmental review.
