RECOMMENDED ACTION: Adopt Resolution No. 2003-210 Agreement with the County of San Diego for animal services. authorizing the City Manager to execute an ITEM EXPLANATION: On May 15, 1986, the City of Carlsbad adopted Resolution No. 9085 approving a contract with the County of San Diego for animal services. The County has provided animal service for over 15 years. On July 1, 1998 the City and County entered into an Agreement for animal services that terminated on June 30, 2003. The Agreement states that the Agreement may be extended by mutual written consent of the parties. This new Agreement would cover services from July 1, 2003, through June 30, 2008. There are two amendments to the Agreement. First, regarding the spay/neuter program, the County will not make any allocations for, or deposits into, the Spay/Neuter Education Trust Fund. This account is adequately funded for at least one year and this temporary program funding break was requested by the contract cities as a budget reduction effort. This will result in a one-time savings of $4,000 to the City of Carlsbad. Second, starting in fiscal year 2004/05, the County may, at the sole discretion of the Director of Animal Services, allocate an amount equivalent to or less than five percent (5%) of the estimated license fee revenue to be collected by the County for deposit into the Spay/Neuter Education Trust Fund. FISCAL IMPACT: The estimated cost of the annual contract is $323,093. Funds totaling $323,093 have been budgeted in the 2003-04 General Fund operating budget. EXHIBITS: 1. Resolution No. 2003-210 2. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Agreement for animal services attached hereto between the City of Carlsbad and the County of San Diego, is hereby ratified. 3. WHEREAS, on July 1,1998 the COUNTY and CITY entered into an Agreement for Animal Control Services whereby the COUNTY, through its Department of Animal Services, provides animal control services to CITY; and WHEREAS, pursuant to Section 1, Term of Agreement, the Agreement for Animal Control Services terminates June 30, 2003; and WHEREAS, the Agreement for Animal Control Services states that the agreement may be extended by mutual written consent of the parties; and WHEREAS, the parties wish to extend the Agreement for Animal Control Services; and WHEREAS, pursuant to Section 8.1, Spay/Neuter Program, the County deposits an amount equal to five percent (5%) of estimated license fee revenues i.t collects into the Spay/Neuter Surcharge Trust Fund; and WHEREAS, the parties wish to amend Section 8.1 to suspend this obligation for one year and make it discretionary thereafter. NOW, THEREFORE, the parties agree as follows: 1. The term of the Agreement for Animal Control Services Between the City of Carlsbad and the County of San Diego dated September 18, 1998, is extended from July 1, 2003 to June 30, 2008. 2. Section 8.1 of the Agreement for Animal Control Services is amended to read as follows: 1 Attach to Resolution No. 2003-210. COUNTY and CITY shall establish a spay/neuter program for The spay/neuter program shall be financed as follows: CITY. a. For fiscal year 2004/05 (July 1, 2004 through June 30, 2005), the COUNTY will allocate an amount equivalent to five percent (5%) of estimated license fee revenues collected by COUNTY for deposit into a separate trust fund account ("Spay/Neuter Surcharge Trust Fund"). COUNTY shall not make any allocations for, or deposits into, this trust fund during fiscal year 2003/04 (beginning July 1, 2003). b. Starting with fiscal year 2005/06 (beginning July 1, 2005), COUNTY may, in the sole discretion of the Director of Animal Services, allocate an amount equivalent to or less than five percent (5%) of estimated license fee revenues collected by COUNTY for deposit into a separate trust fund account ("Spay/Neuter Surcharge Trust Fund") . 3. All other terms and conditions in the Agreement for Animal Control Services Between the City of Carlsbad and the County of San Diego dated September 18, 1998 remain in full force and effect during the extension unless the agreement is terminated pursuant to its terms. DeputyClerk 1 SIXTH AMENDED AGREEMENT BETWEEN THE COUNTY OF SAN DIEGO AND THE CITY OF CARLSBAD FOR THE PROVISION OF ANIMAL CONTROL SERVICES 3% AMENDh4ENT TO AGREEMENT is made and entered into this /3 day of the County of San Diego (“County”) and the City of Carlsbad (“City”): WHEREAS, CITY and COUNTY entered into a Provision of Animal Control Services Agreement, dated September 15, 1998 (“Agreement”), whereby the COUNTY agreed to provide animal control services to CITY under terms and conditions of that Agreement; and, WHEREAS, ClTY and COUNTY wish to amend the Agreement to establish payment obligations for fiscal year 2003/2004. NOW THEREFORE, CITY and COUNTY agree as follows: I) Attachment B of the Agreement is amended to read as follows: This Joint Operating and Financial Plan, made and agreed to for the period beginning July 1, 2003, and ending June 30,2004, by and between the City of Carlsbad and the County of San Diego shall become a part of the Agreement between said parties. The County of San Diego shall provide animal control services to the City of Carlsbad as specified in Sections 3 through 5 of the Agreement. The gross cost of providing animal control services to the City of Carlsbad from July 1,2003, through June 30,2004, shall be %52,993. The County shall collect license and other fees, as specified under the County’s Animal Control Services Fee Resolution within the City of Carlsbad. From July 1,2003, through June 30,2004, the estimated revenue amount to be collected within the City of Carlsbad is $129,900. After deducting estimated revenues from gross cost, the City of Carlsbad shall pay County the net amount of $323,093. The City of Carlsbad shall pay County in payments as specified in Section 6, paragraph 5, of the Agreement. 2) All other terms and conditions contained in the Agreement shall remain unchanged.
