Adopt Resolution No. 2003-220 accepting the construction of the Chestnut Avenue Parkway
Improvements, Project No. 3851, as complete, and authorizing the City Manager to approve additional change
orders, and directing the City Clerk to record a Notice of Completion and release bonds in accordance with State
Law and City Ordinances and authorizing additional contingency.
ITEM EXPLANATION:
In 1999, a new sidewalk was constructed along the southerly side of Chestnut Avenue from El Camino Real to 300'
west of Donna Drive. The sidewalk project resulted in the roadway being widened on the south side between El
Camino Real and Cameo Road. In widening the roadway, the ground elevation adjacent to the first three
residential properties east of El Camino Real was raised resulting in a loss of privacy in their backyards. To restore
their privacy, the subject project included installation of a low retaining wall, a seven-foot privacy fence, and
landscaping along the southerly parkway of Chestnut Avenue.
On April 9, 2002, Sean Malek Engineering and Construction, Inc. was awarded a contract in the amount of $71,100
for the construction of the Chestnut Avenue Parkway Improvements, Project No. 3851. Sean Malek Engineering
and Construction, Inc. completed the street improvement work on November 1, 2002, and the landscape
maintenance period was completed on January 29, 2003. City staff has inspected the work and found it to be
satisfactory. Staff recommends formal acceptance of the improvements by the City Council.
At the completion of the construction the contractor submitted a request for reimbursement for water capacity fees
charges that were not included in the contract bid documents. Staff has reviewed and supports this request.
Currently there are not sufficient funds in the construction and contingency funds to pay this request. Staff is
requesting that the remaining project funds of $4,957 be allocated to the contingency fund to allow staff to pay this
and other minor projects to close out the project.
FISCAL IMPACT:
There are sufficient project funds available to allocate an additional $4,957 to the construction contingency fund.

RESOLUTION NO. 2003-220
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION
OF THE CHESTNUT AVENUE PARKWAY IMPROVEMENTS
PROJECT NO. 3851, AND AUTHORIZING THE APPROVAL OF
ADDITIONAL CHANGE ORDER FUNDS.
WHEREAS, the construction of the Chestnut Avenue Parkway Improvements has
been completed to the City’s satisfaction by Sean Malek Engineering and Construction, Inc.
on January 29,2002; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, the contractor has submitted a request for reimbursement for project
related costs in excess of the approved project contingency amount; and
WHEREAS, staff has reviewed and supports this request; and
WHEREAS, sufficient funds are available in the original project budget to cover the
added change order expenses.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:

2. That the Chestnut Avenue Parkway Improvements, specifically identified as
Project No. 3851, is deemed complete and is hereby accepted by the City Council of the City
of Carlsbad.
That the above recitations are true and correct.
3. That the City Manager is hereby authorized to approve additional change orders
on the project up to $4,957.
4. That sufficient funds are available in the original project budget to cover the
added change order expenses.
5. The City Clerk of the City of Carlsbad is hereby authorized and directed to
execute and record the Notice of Completion for the Chestnut Avenue Parkway
Improvements, Project No. 3851.

6. That the City Clerk is directed to release all bonds on Project No. 3851 in
accordance with State Law and City Ordinances.

The developer has constructed the improvements required for Project No. CT 99-02 Poinsettia Properties PA7, Agreement Number SECA9934, Drawing Number 382-5 and has requested that the City of Carlsbad accept the public improvements. City forces have inspected the public improvements and found them to be satisfactory. The public improvements consist of:
