HomeMy WebLinkAbout2003-10-07; City Council; 17335; Construction of Cannon Road Lift StationCITY OF CARLSBAD - AGENDA BILL I 17,335 4B# klTG. 10/07/03 TITLE: REJECT ALL BIDS AND AUTHORIZATION TO RE-ADVERTISE FOR BIDS FOR CONSTRUCTION OF THE CANNON ROAD LIFT STATION PROJECT NO. 3583 RECOMMENDED ACTION: Adopt Resolution No. 2003-261 to reject all bids and authorize the City Clerk to re-advertise for bids for construction of the Cannon Road Lift Station, Project No. 3583. ITEM EXPLANATION: On July 8, 2003, the City Council adopted Resolution No. 2003-175 approving the plans and specifications and authorizing the advertisement for bids for the construction of the Cannon Road Lift Station. The Engineer’s Estimate for Project No. 3583 was $2,900,000. On September 4, 2003, the Purchasing Department received seven (7) sealed bids as follows: Staff has reviewed the bid packages and found four of the seven bidders, including the 2 low bidders, to be non-responsive. The deficiency of the non-responsive bidders is due to the experience requirement clause in the bid documents for caisson construction experience. Responsive bid documents required bidders to submit evidence of their caisson experience (or their subcontractor’s caisson experience) of three caisson projects of a specific size and depth or greater. Because of site constraints and soil conditions, the project requires the caisson construction method be utilized to construct the pump station. Receiving responsive caisson construction experience references from bidders was critical to the City’s bid evaluation process for the Cannon Road Lift Station Project. Additionally, the third low bidder did not provide proof of experience of a similar character to that required for construction of a lift station. Because of these issues, staff recommends that the City Council reject all bids received on September 4, 2003, as allowed by the provisions of California Public Contract Code Section 22038, and authorize the advertisement to receive new bids for the construction of the Cannon Road Lift Station. City staff has taken measures to clarify the specific caisson and pump station construction experience requirements in the revised bid documents. Additionally, staff will emphasize to prospective bidders during the pre-bid meeting the importance of complying with the experience requirement. Staff also intends to directly notify other experienced caisson contractors located in Southern California of this project to develop more interest in providing bids. Staff has also incorporated comments received during the bid phase into the contract documents and requests the City Council’s approval of a revised set of plans and specifications, which are ready for bidding, and available for inspection at the Public Works Engineering Department. ENVIRONMENTAL REVIEW: A Mitigated Negative Declaration and Mitigation Monitoring Program was prepared for the Project and adopted by the Planning Commission on February 19, 2003 (Planning Commission Resolution No. 5343). The Planning Commission approved a Conditional Use Permit (CUP 02-11), a Site Development Plan (SDP 02-1 7), and a Coastal Development Permit (CDP 02-22) on February 19, 2003 by Planning Commission Resolution Nos. 5344, 5356, and 5345, respectively. Page 2 of Agenda Bill No. 17,335 FISCAL IMPACT: Funding for this project is provided from sewer benefit area fees collected by the City from development projects, which are tributary to the South Agua Hedionda Sewer Basin. The cost to reject bids, make minor revisions to the contract documents and re-advertise for bids is considered to be insignificant relative to the construction cost. Reproduction costs for bid packages will be offset by bidder’s payment for the bid packages. Upon review of the bids received and the complexity of the construction, the estimated construction cost has been increased by $300,000. AUTHORIZING THE CITY CLERK TO RE-ADVERTISE FOR BIDS WHEREAS, the City Council of the City of Carlsbad has previously approved the plans and specifications and authorized the advertisement for bids for the construction of the Cannon Road Lift Station, Project No. 3583; and WHEREAS, seven (7) sealed bids were received on September 4, 2003 by the City of Carlsbad for the construction of the Cannon Road Lift Station, Project No. 3583, and were subsequently reviewed by staff; and WHEREAS, with respect to all seven bids, the City hereby finds it necessary, desirable, and in the public interest to follow the provisions of California Public Contracts Code, Section ,2038, whereby the City, in its discretion, may reject all bids and elect, in its further discretion, to seek new bids for this project; and WHEREAS, the City Council of the City of Carlsbad, California, has determined it iecessary, desirable, and in the public interest to construct the Cannon Road Lift Station, 'reject No. 3583; and WHEREAS, the plans and specifications as modified for the construction of the Cannon ?oad Lift Station, Project No. 3583, have been prepared and are on file in the Public Works- Sngineering Department of the City of Carlsbad and are incorporated by reference herein; and WHEREAS, there are sufficient funds available to construct the project, which have been :ollected from sewer benefit area fees; and WHEREAS, a Mitigated Negative Declaration and Mitigation Monitoring Program has been idopted by Planning Commission Resolution No. 5343, dated February 19, 2003, as required by he California Environmental Quality Act; and 'I 'I 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 ' 26 27 28 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. 2. That the City Council does hereby reject all seven (7) bids received on September4, 2003, for the construction of the Cannon Road Lift Station, Project No. 3583, in accordance with the provisions of California Public Contracts Code Section 22038. That the above recitations are true and correct. 3. That the City Council does hereby authorize the Purchasing Officer to return all bid bonds received for this bid (Project No. 3583) to the respective bidders. 4. That the plans and specifications as modified for the construction of the Cannon Road Lift Station, Project No. 3583, are hereby approved. 5. That the City Clerk of the City of Carlsbad is hereby authorized and directed to publish, in accordance with State law, a Notice to Contractors Inviting Bids for the construction of the Cannon Road Lift Station, Project No. 3583, in accordance with the revised plans, specifications, and contract documents referred to herein.
